Responses to the Questionnaire on Improving criminal justice in cyberspace
Dear Migration and Home Affairs,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents relevant to the investigation by the European Commission Task Force on Cross-border Access to Electronic-Evidence on Improving criminal justice in cyberspace, which contain the following information:
--EU Member state responses to the “QUESTIONNAIRE for EU MEMBER STATES following the 9 June 2016 Conclusions of the JHA” on Improving criminal justice in cyberspace.
--The summary report which analyzes those questionnaire responses.
--Communication on the next steps to be taken by the task force (or the Commission) as derived from the questionnaire.
--Supplementary documents submitted by other responsible ministries, prosecutors, and/ or national or regional police.

"This questionnaire is designed to provide further information to the European Commission Task Force on Cross-border Access to Electronic-Evidence, in order to facilitate swift progress of our work. We would be grateful for receiving your replies by Friday 16 September 2016. Whereas some of the questions mainly refer to the legal framework, other questions are more related to current (working) practices in your Member State. The diversity in questions may require you to involve multiple organisations, including e.g. your responsible ministry, prosecutors and / or your national or regional police."
Similarly to the Encryption of Data Questionnaire 12368/16, which was declassified by the Council in October and the responses of which have been largely made public; the responses to the Questionnaire for EU Member States on Improving criminal justice in cyberspace should be accessible to all stakeholders, especially academics and civil society, for further analysis and better understanding of the decision-making process.
