Your request covers a period of time between 1st January  2017 and 27th of

Considering the parameters of your request, the handling of your
application involves the assessment of potentially a very large number of
documents originating from different services of the directorate and from
third parties. The analysis of these documents, together with the need to
consult the third parties concerned in accordance with Article 4(4) and
4(5) of Regulation 1049/2001 when needed cannot be expected to be
completed within the normal time limits set out in Article  7 of
Regulation 1049/2001.

 

As stated by the EU Courts, the European Commission needs to respect the
principle of proportionality and ensure that the interest of the applicant
for access is balanced against the workload resulting from the processing
of the application for access, in order to safeguard the interests of good
administration.  

 

Therefore article 6(3) of Regulation 1049/2001 provides that in the event
of an application relating to a very long document or to a very large
number of documents, the institution concerned may confer with the
applicant informally, with a view to finding a fair solution.

 

In accordance with the case law of the EU Court, a fair solution can only
concern the content or the number of documents applied for, not the
deadline for replying. This means that the scope of your requests must be
reduced in a way that would enable its treatment  within the extended
deadline of 15+15 working days.

 

Based on the above-mentioned provision, we would kindly ask to narrow down
the scope of your request (i.e; the precise subject matter/timeframe
covered), so as to reduce it to a more manageable number.

Please note in this regard that, for example, there are potentially
thousands of documents containing the word(s) ‘SAM’ or ‘SAM unit’, given
that this is the denomination of one of the services within DG RTD.
Therefore, we would kindly request you to specify the objective of your
wide-scoped request and your specific interest in the documents requested.

 

Therefore, in order to limit the excessive administrative burden relating
to the handling of your wide-scoped request, we propose you to:

-          restrict the scope of your request to meetings held by the

Thank you for your message of 11 April 2019.

 

We assessed your clarifications and we regret to have to confirm that your
request needs to be restricted as its scope is still too broad for being
handled within the deadline.

 

In your reply, you confirmed your intention of receiving documents
mentioning the words “SAM, SAM Unit, Scientific Advice Mechanism” together
with either “Sustainable Food Systems” or “ Sustainable Food Production”,
of the entire staff of DG RTD and not only of the senior management.
Unfortunately the Commission’s tools for document management do not allow
to perform such a search based on combined criteria.

 

However, in order to address your request as thoroughly as possible we
have performed a preliminary and rough search in the document management
tool using the available functionalities and we could identify a minimum
of 250 documents for each of the criteria mentioned in your message, only
for the past year. This volume of documents cannot be processed within the
time limit prescribed by the Regulation. Therefore we invite you to
reconsider a restriction of the scope of your request and to identify some
documents which you would like to give priority to.

Whether the proposal as per our message of the 11 April 2019 does not
correspond to your interest, we kindly ask you to provide an alternative
but equally manageable solution.

 

Regarding your reference to previous access to documents requests, we
would like to clarify that over the years the Commission practice has
changed towards the handling of wide-scoped requests.

Unfortunately, taking into account the high number of requests for access
to documents we receive and the limited resources available, the documents
need to be limited to a manageable number, in order to safeguard the
interests of good administration.

For this reason, the Regulation provides for a possibility to confer with
the applicant in order to find a fair solution (see Article 6.3 of
Regulation 1049/2001). Please be reassured that the purpose of this
attempt to find a common agreement on the restriction is to process your
request and provide you with a reply, both aligned to your interests and
timely. Furthermore, we would also like to highlight that each access to
documents request requires an ad hoc assessment which has to take into
account all the specificities of the case.

 

We are looking forward to receiving your proposal on the restriction of
the scope and we thank you in advance for your kind cooperation.

 

We remind you that, should we not be able to find a proper solution, with
a view to safeguarding the interests of good administration, unfortunately

We assessed your clarifications and we regret to have to confirm that
your  request needs to be restricted as its scope is still too broad for
being  handled within the deadline.

 

 

 

In your reply, you confirmed your intention of receiving documents 
mentioning the words “SAM, SAM Unit, Scientific Advice Mechanism”
together  with either “Sustainable Food Systems” or “ Sustainable Food
Production”,  of the entire staff of DG RTD and not only of the senior
management.

Unfortunately the Commission’s tools for document management do not allow 
to perform such a search based on combined criteria.

 

 

 

However, in order to address your request as thoroughly as possible we 
have performed a preliminary and rough search in the document management 
tool using the available functionalities and we could identify a minimum 
of 250 documents for each of the criteria mentioned in your message, only 
for the past year. This volume of documents cannot be processed within
the  time limit prescribed by the Regulation. Therefore we invite you to 
reconsider a restriction of the scope of your request and to identify
some  documents which you would like to give priority to.

 

Whether the proposal as per our message of the 11 April 2019 does not 
correspond to your interest, we kindly ask you to provide an alternative 
but equally manageable solution.

 

 

 

Regarding your reference to previous access to documents requests, we 
would like to clarify that over the years the Commission practice has 
changed towards the handling of wide-scoped requests.

 

Unfortunately, taking into account the high number of requests for access 
to documents we receive and the limited resources available, the
documents  need to be limited to a manageable number, in order to
safeguard the  interests of good administration.

 

For this reason, the Regulation provides for a possibility to confer with 
the applicant in order to find a fair solution (see Article 6.3 of 
Regulation 1049/2001). Please be reassured that the purpose of this 
attempt to find a common agreement on the restriction is to process your 
request and provide you with a reply, both aligned to your interests and 
timely. Furthermore, we would also like to highlight that each access to 
documents request requires an ad hoc assessment which has to take into 
account all the specificities of the case.

 

 

 

We are looking forward to receiving your proposal on the restriction of 
the scope and we thank you in advance for your kind cooperation.

 

 

 

We remind you that, should we not be able to find a proper solution, with 
a view to safeguarding the interests of good administration,
unfortunately  we will be obliged to balance your possible interest in
access against the  workload resulting from the processing of your
application, unilaterally  restricting the scope of your application to
