GESTDEM No 2019/3777

Envoyé par ve_sg.accessdoc (SG) <[DG SG request email]>. Toutes les

Dear Mr Teffer,

We refer to your email of 1 July 2019 in which you make a request for
access to documents, registered on the same day under the above-mentioned
reference number.

You requested access to, I quote, ‘[…]  all documents - including but not
limited to minutes, (hand-written) notes, audio recordings, verbatim
reports, operational conclusions, lines to take, e-mails, and
presentations - related to all meetings secretary-general Martin Selmayr
has held with organisations or self-employed individuals since 1 March
2018’.

Your application concerns a very large number of documents, which need to
be assessed individually. Such a detailed analysis cannot be carried out
within the normal time limits set out in Article 7 of Regulation (EC) No
1049/2001.

However, the Regulation also provides for a possibility to confer with
applicants in order to find a fair solution when an application relates to
a very long document or concerns a very large number of documents. Article
6(3) provides that in the event of an application relating to a very long
document or to very large number of documents, the institution concerned
may confer with the applicant informally, with a view to finding a fair
solution.

In accordance with the case law of the EU Courts, such a solution can only
concern the content or the number of documents applied for, not the
deadline for replying.[5][1] This means that the scope of the request must
be reduced in a way that would enable its treatment within the extended
deadline of 15 + 15 working days.

Based on the above-mentioned provision, we would kindly ask you to specify
the objective of your request and your specific interest in the documents
requested[6][2], and whether you could narrow down the scope of your
request (i.e. the subject matter(s) and/or timeframe covered), so as to
reduce it to a more manageable amount of documents.

In order to help you to narrow down your request, please note that the
documents, amounting to more than 360 pages in total, have been identified
as falling under the scope of your request:

-          Briefing for the meeting with the Spanish Confederation of
Employers' Organisations (CEOE) Brussels, 11 June 2019;

-          Briefing for the meeting with EuroCommerce Brussels, 5 June
2019;

-          Briefing for the meeting with Spanish Chamber of Commerce in
Belgium and Luxembourg Brussels, 28 May 2019;

-          Briefing for the meeting with ‘Wirtschaftsrat der CDU e.V’, 7
May 2019;

2019;

-          Briefing for the meeting with the Centre for European policy

Bundesverband der Deutschen Industrie, 25 January 2019;

-          Briefing for the meeting with Bundesverband der Deutschen
Industrie e.V. (BDI), 6 November 2018;

-          Briefing for the meeting with McLarty Associates , 5 November
2018;

-          Briefing for the speech at the American European Community
Association, Brussels, 25 October 2018 ;

-          Briefing for the meeting with EuroComment Policy Dialogue
Brussels, 5 October 2018;

-          Briefing for ARGO-Brussels Hellenic Network Dinner, 4 October
2018 ;

-          Briefing for the meeting with vbw - Vereinigung der Bayerischen
Wirtschaft e. V. (vbw)‘, 11 July 2018;

-          Briefing for the meeting with the Centre for European Reform
Brussels, 10 July 2018.

Please note that these documents have been identified on the basis of a
research conducted in the European Commission’s corporate document
management systems, based on the data available on meetings in the
transparency register for the indicated period.

According to our first estimates, the handling of your request would take
more than 15 working days working days[7][3], broken down as follows:

-          assessment of the content of the documents in light of the
exceptions of Article 4 of Regulation  (EC) No 1049/2001

-          possible third-party consultations under Article 4(4) of
Regulation (EC) No 1049/2001

-          final assessment of the documents in light of the comments
received from our hierarchical superiors;

-          drafting of the reply;

-          redaction of those parts of the documents to which one or
several exceptions apply(ies);

-          internal approval of the draft decision on your request;

-          preparation of the reply and the documents for dispatch
(scanning of the redacted versions, administrative treatment).

In order to enable us to deal with your application within the prescribed
time limit, we are suggesting that you limit the scope of your request to
cover documents in relation to meetings with a maximum 4 of the entities
enumerated above, of your choice.

In order to enable us to respect the time-limits of Regulation (EC) No
1049/2001, we would ask you for a swift reply to our invitation to propose
a fair solution, within five working days at the latest:

·         by email to: [8][email address]

If you have any questions concerning the invitation, you can contact Ms
Aneliya Fidanova:

·         by email at: [email address]

In the absence of a reply within five working days, we will unilaterally
restrict the scope of your application to those parts that can be dealt
with within the extended deadline of 30 working days, counting from the
registration of your application.

Thank you in advance for your understanding and cooperation.

Yours sincerely,

Dear Mrs Oliván Avilés,

Thanks for your e-mails dated 19 and 23 July 2019, related to my access to documents request registered on 02/07/2019 under reference number GestDem 2019/3777.

There are 21 documents which you seem to have identified (you have identified 'Briefing for the meeting with Bundesverband der Deutschen Industrie e.V. (BDI), 6 November 2018' twice), 20 of them defined as 'briefings'. Can you confirm that for all meetings, no written documents exist about what was said in those meetings, but only briefings (which de facto are written before meetings take place)?

I can accept that the handling of more than 360 pages would be difficult within the legal deadline, but I find the suggestion to limit my request to merely four documents to be too limited.

Frankly, you are being too modest. I know from experience that the Commission is perfectly capable to handle more than four documents within the legal deadline of the access to documents regulation.

However, I am also in favour of an amicable solution. Let's both compromise so that I restrict my request to the following seven documents:

- Briefing for the meeting with Bundesverband der Deutschen Industrie e.V. (BDI), 6 November 2018;

- Briefing for follow-up meeting on the event organised by Bundesverband der Deutschen Industrie, 25 January 2019;

- Briefing for meeting with Rechtsanwalt Roland Koch, 20 December 2018;

- Briefing for the meeting with Airbus, 18 December 2018;

- Brussels, 9 November 2018;

- Briefing for the meeting with McLarty Associates , 5 November 2018;

- Briefing for the meeting with vbw - Vereinigung der Bayerischen Wirtschaft e. V. (vbw)‘, 11 July 2018;

All the best,
Peter Teffer

Dear Mr Teffer,

We would like to thank you very much for your answer and for your
cooperation in finding a fair solution.

As mentioned in our first email of 19 July 2019, the list of documents
provided has been elaborated on the basis of a research conducted in the
European Commission’s corporate document management systems, based on the
data available on meetings in the transparency register for the indicated
period.

Please note that a briefing usually contains many pages. Therefore, we
regret to inform you that unfortunately the amount of pages concerned by
your proposal is still too important to be handled within the prescribed
deadline. Namely the following numbers of pages are concerned by your
proposal:

- Briefing for the meeting with Bundesverband der Deutschen Industrie e.V.
(BDI), 6 November 2018: 18 pages.

- Briefing for follow-up meeting on the event organised by Bundesverband
der Deutschen Industrie, 25 January 2019: 25 pages.

- Briefing for  meeting with Rechtsanwalt Roland Koch, 20 December 2018:
13 pages.

- Briefing for the meeting with Airbus, 18 December 2018: 3 pages.

- Briefing for meeting with Open Society European Policy Institute
Brussels, 9 November 2018: 14 pages.

- Briefing for the meeting with McLarty Associates , 5 November 2018: 63
pages.

- Briefing for the meeting with vbw -Vereinigung der Bayerischen
Wirtschaft e. V. (vbw)‘, 11 July 2018: 14 pages.

We would like to inform you that a maximum of approximately 60 pages could
possibly be dealt with within the extended deadline. Please also note that
third parties and inter-services consultations might also need to take
place in relation to your request. We would like to point out in this
context, that the Court has already recognised in its judgement  of 2
October 2014, (C-127/13) that a proposal for a fair solution may concern
only the number and content of the documents applied for, not the deadline
for replying.

In order to enable us to provide you with a reply as soon as possible, we
would ask you for a swift response to our proposal for a fair solution at
your earliest convenience.

Unfortunately, in the absence of a reply within five working days, we will
be forced to unilaterally restrict the scope of your application to those
parts that can be dealt with within the extended deadline, counting from
the registration of your application, in order to  provide you with a
reply to your access to documents request.

Finally, we would like to inform you that upon receipt of the initial
reply you remain free to submit a new request for access to documents.

Many thanks for your cooperation in advance.

Kind regards,
