We refer to your email of 1 July 2019 in which you make a request for
access to documents, registered on the same day under the above-mentioned
reference number.

You requested access to, I quote, ‘[…]  all documents - including but not
limited to minutes, (hand-written) notes, audio recordings, verbatim
reports, operational conclusions, lines to take, e-mails, and
presentations - related to all meetings secretary-general Martin Selmayr
has held with organisations or self-employed individuals since 1 March
2018’.

Your application concerns a very large number of documents, which need to
be assessed individually. Such a detailed analysis cannot be carried out
within the normal time limits set out in Article 7 of Regulation (EC) No
1049/2001.

 

However, the Regulation also provides for a possibility to confer with
applicants in order to find a fair solution when an application relates to
a very long document or concerns a very large number of documents. Article
6(3) provides that in the event of an application relating to a very long
document or to very large number of documents, the institution concerned
may confer with the applicant informally, with a view to finding a fair
solution.

 

In accordance with the case law of the EU Courts, such a solution can only
concern the content or the number of documents applied for, not the
deadline for replying.[5][1] This means that the scope of the request must
be reduced in a way that would enable its treatment within the extended
deadline of 15 + 15 working days.

 

Based on the above-mentioned provision, we would kindly ask you to specify
the objective of your request and your specific interest in the documents
requested[6][2], and whether you could narrow down the scope of your
request (i.e. the subject matter(s) and/or timeframe covered), so as to
reduce it to a more manageable amount of documents.

According to our first estimates, the handling of your request would take
more than 15 working days working days[7][3], broken down as follows:

-          assessment of the content of the documents in light of the
exceptions of Article 4 of Regulation  (EC) No 1049/2001

-          possible third-party consultations under Article 4(4) of
Regulation (EC) No 1049/2001

-          final assessment of the documents in light of the comments
received from our hierarchical superiors;

-          drafting of the reply;

-          redaction of those parts of the documents to which one or
several exceptions apply(ies);

-          internal approval of the draft decision on your request;

-          preparation of the reply and the documents for dispatch
(scanning of the redacted versions, administrative treatment).

In order to enable us to deal with your application within the prescribed
time limit, we are suggesting that you limit the scope of your request to
cover documents in relation to meetings with a maximum 4 of the entities

Dear Mrs Oliván Avilés,

Thanks for your e-mails dated 19 and 23 July 2019, related to my access to documents request registered on 02/07/2019 under reference number GestDem 2019/3777.

There are 21 documents which you seem to have identified (you have identified 'Briefing for the meeting with Bundesverband der Deutschen Industrie e.V. (BDI), 6 November 2018' twice), 20 of them defined as 'briefings'. Can you confirm that for all meetings, no written documents exist about what was said in those meetings, but only briefings (which de facto are written before meetings take place)?

I can accept that the handling of more than 360 pages would be difficult within the legal deadline, but I find the suggestion to limit my request to merely four documents to be too limited.

Frankly, you are being too modest. I know from experience that the Commission is perfectly capable to handle more than four documents within the legal deadline of the access to documents regulation.

However, I am also in favour of an amicable solution. Let's both compromise so that I restrict my request to the following seven documents:

- Briefing for the meeting with Bundesverband der Deutschen Industrie e.V. (BDI), 6 November 2018;

Thank you for your reminder. We are aware of the fact that the second
deadline for your request Gestdem 2019-3777 expires today.

We would like to thank you again for kindly agreeing to reduce the scope
of your wide-scoped request. Nonetheless, I regret to have to inform you
that we will not be able to respond within the extended time-limit.  I
