Services notifications and stakeholder comments

Dear Internal Market, Industry, Entrepreneurship and SMEs,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- all information published on the Commission's website about incoming notifications regarding services
- all comments provided to the Commission by stakeholders concerning incoming notifications regarding services

The background for this request is as follows: in the notes from the Commission's meeting with EuroCommerce in November 2019, DG GROW mentions that it "informed EuroCommerce that the Commission during the summer had decided to publish information on all incoming notifications on its webpage. Stakeholders are invited to provide comments to the Commission if they wish to do so (as is the case already for notifications in the area of goods for a long time)."

The publishing of notifications by public authorities of new rules and regulations regarding services and the idea of inviting stakeholders to comment was one of the central components of the proposed services notification directive. It appears that the Commission is now unilaterally implementing this, without the services notification directive being agreed. There does not seem to have been any public announcement of this new approach (except for a brief, unspecific mention in the Single Market Enforcement Action Plan last month). This means public scrutiny of the new approach is currently impossible. There is therefore a clear public interest in releasing the requested documents.
