First of all, thanks for your reply to my access to documents request which was registered on 15/02/2018 under reference number GestDem 2018/994. I appreciate the time taken to send the reply.
Please pass this on to the person who reviews confirmatory applications.
I am filing the following confirmatory application with regards to my access to documents request 'Southern Gas Corridor Advisory Council', which was registered on 15/02/2018 under reference number GestDem 2018/994.
I would like you to reconsider the disclosure of document 2 for the following reason. Regulation 1049/2001 article 4(1)a third indent does indeed provide a possibility to refuse access if disclosure would undermine the protection of the public interest as regards international relations. However, I feel it has not been clearly explained why the public interest would be more at stake than if it were disclosed. The Southern Gas Corridor is of vital importance to EU citizens, both because they have an interest in security of supply but also because of negative consequences of fossil fuels on climate change.
Additionally, I would like you to check again whether all documents have been identified to which I referred (All preparatory documents, presentations, minutes and verbatim reports related to the 4th Southern Gas Corridor Advisory Council held on 14 February 2018.) No minutes or verbatim reports were identified. I find it very difficult to believe that at such a high-level event like the Southern Gas Corridor Advisory Council, no one produced verbatim reports or even took any minutes.
As for the refusal to release document 3 and 4, can you explain why the agenda and the joint declaration are treated as documents for which the permission of the government of Azerbaijan is required? The name of joint declaration suggests that it is a joint declaration. Should this not give the EU side the right to decide whether to disclose it? It is peculiar that the Commission would allow Azerbaijan to decide whether and when to publish the joint declaration.
