Standard modalities for hearings referred to in Article 7(1) TEU
Dear Council of the EU,
In Sibiu in May 2019, European leaders unanimously committed to ‘continue to protect our way of life, democracy and the rule of law’. The European Council has confirmed the Sibiu commitment in its Strategic Agenda adopted on 21 June 2019, which provides inter alia that “the common values underpinning our democratic and societal models are the foundation of European freedom, security and prosperity” and that the rule of law “must be fully respected by all Member States and the EU”.
Considering this renewed commitment to uphold the values on which the EU is based (Article 2 TEU), the fundamental legal obligation for each EU Member State to respect and promote these value (Articles 2, 7 and 49 TEU), not to mention the obvious overriding public interest in enabling European citizens to assess whether the Council is taking its obligations seriously under Articles 2 and 7 TEU, I am writing to request the disclosure of the following three documents under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001:
1/ Document no ST 10641 2019 INIT
2/ Document no ST 10641 2019 REV 1
3/ Document no ST 10641 2019 REV 2
All of these documents have the same title: “Standard modalities for hearings referred to in Article 7(1) TEU”.
Considering the Council’s repeated commitments to uphold the foundational values on which the EU at a time where they are under serious threat in at least the two EU countries currently subject to Article 7(1) TEU proceedings, it is difficult to understand why the Council is preventing European citizens from being able to understand how Article 7 hearings are organised in practice.
It is important to recall in this respect that the previous set of procedural modalities governing Article 7(1) TEU hearings were made available (see e.g. section II of Document no 14621/18) and more generally speaking, the primary law obligations which binds the Council when it comes to the transparency of its proceedings.
It is therefore difficult to understand why the Council has not already made public the three documents listed above and entitled “Standard modalities for hearings referred to in Article 7(1) TEU” and hope you will remedy this situation promptly.
