Service juridique

Dear Mr. Haagensen,

We refer to your e-mail of 22 May 2018 requesting, under Regulation (EC) No 1049/2001, access to the legal submissions of the parties and interveners/observers in joined Cases C-62/14 (Gauweiler) and C‑370/12 (Pringle).

The submissions made by the Commission in both cases have already been disclosed following previous requests for access under Regulation 1049/2001. They are publicly available in the Legal Service's website:
http://ec.europa.eu/dgs/legal_service/su...

As regards the submissions made by other parties, the Legal Service has identified 15 documents in case C-370/12 and 18 documents in case C-62/14 as falling within the scope of your request.

Regarding third-party documents, Article 4(4) of Regulation (EC) No 1049/2001 provides that the institution shall consult the third party with a view to assessing whether an exception in paragraph 1 or 2 is applicable. Therefore, the Legal Service will consult all the parties on the disclosure of their documents and give them a deadline (10 working days) in order they communicate us the conclusions of their assessment.

Your request is currently being treated. However, as indicated above it concerns a large number of documents. The consultation period referred to above adds an additional administrative step to the handling of the requests. Therefore, it will not be possible for the Legal Service to provide you with the reply within the time limit set by Article7(2) of Regulation 1049/2001 regarding public access to documents.

In this respect please also note that the Commission cannot privilege one applicant and has to guarantee that all the requests are dealt with within the deadlines of Regulation (EC) No 1049/2001 or, where not possible as in the present case, to seek for a fair solution, in conformity with Article 6(3) of Regulation (EC) No 1049/2001, that reconciles the interests of the applicant with those of good administration. Please be aware, that following the judgment of the Court in Case C-213/15P Breyer, the Commission has received a large number of access requests concerning a very large total number of documents.

In view of the foregoing, we would like to propose to you a fair solution that enables us to conciliate your interest with the principle of good administration and without prejudice to other applicants' requests. Consequently, we would propose to handle your application by successive batches, taking into consideration the number of documents concerned by each of the cases, as follows:

– First batch: case C-370/12.

Once we have finished the treatment of the first batch we will register the second one concerning C-62/14 and deal with it. Please let us know whether you prefer that we deal first with case C-370/12 or with case C-62/14.

We would kindly ask you for your agreement on this proposal.

In relation to your preference regarding the language version of the documents, please note that they are available in the language of the Member State/intervening party, in the language of the proceedings and in French. The language of the proceedings in Case C-62/14 was German and in Case C-370/12 English. Therefore, could you please specify in what language would you like to receive the documents in case C-62/14 ?

Yours sincerely,

Dear Legal Service,

Thank you for your response.

I acknowledge your proposal and agree with the suggestion of the first batch being case C-370/12, and the second batch being case C-62/14.

Where possible, I would like all documents in English, so for case C-62/14 I would like English, but if that's not possible then German.

Yours faithfully,

Nicholas Haagensen

Dear Mr Haagensen,

We refer to your request for access to documents under Regulation (EC) No
1049/2001 regarding public access to European Parliament, Council and
Commission documents (OJ L 145, 31.05.2001, page 43).

Your request is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which is expiring today. An extended time limit
is needed as your request concerns documents of which the Commission is
not the author. According to Article 4(4) of Regulation (EC) No 1049/2001,
the Commission has to consult the third parties from which the documents
originate. This consultation procedure adds an additional administrative
step to the handling of your access request.

Moreover, following the judgment of the Court in Case C-213/15P, Breyer,
the Commission has received a large number of access requests concerning a
very large total number of documents. Therefore, it will not be possible
to provide you with the reply within the time limit set by Article 7(2) of
Regulation (EC) No 1049/2001 regarding public access to documents. A reply
will be provided to you as soon as possible.

We apologise for this delay and for any inconvenience this may cause.

Yours sincerely,

4(4) of Regulation (EC) No 1049/2001. This process of consultation is
still ongoing. Please be assured that we will do our utmost to send you

Nicholas Haagensen

Dear Legal Service,

I have still not heard from you about my request for submissions in case C-62/14 (reference GestDem 2018/4071), which constitutes the 2nd batch of my previous request of 22/05/2018 in accordance with the fair solution agreed upon on 24/05/2018. I understand you are busy, but it is now mid-October and the last time I heard from you was August 28 2018 when we agreed that you would first deal with the submissions in case C-62/14 before looking at another request I made for submissions concerning joined cases C-8/15P and C-10/15P.

Please get back to me as soon as possible on the status of submissions in case C-62/14 (reference GestDem 2018/4071).

Yours faithfully,
Nicholas Haagensen
