Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Any reports, documents, annexes, notes, etc received by Mrs Catherine Day from EU audit bodies (OLAF, court of auditors, European audit services ) related to irregularities and false accounting at Danish Institute for Human Rights.
Any measures issued by Ms Day following those reports (relevant documents ).

I refer to your request sent by mail on 8^th October 2013.  This request
for access to documents was registered under n° GESTDEM 2013/4989.
 
Your application is currently being handled.  However, we will not be in a
position to complete the handling of your applications within the time
limit of 15 working days, which expires on 30/10/2013.
 
Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 21/11/2013.

I am writing to request an internal review of Secretariat General (SG)'s handling of my FOI request 'Submissions to Ms Cathrine Day -SG'.

By letter Ares(2013)3519210 - 19/11/2013 http://www.asktheeu.org/en/request/880/r... SG refused my request to access specific documents, motivating that:

"Following intensive research, we have been unable to identify any document as falling within the scope of your request, which is therefore devoid of purpose".

OLAF Director - Mr Kessler refers here in his letter 30647/29 11 2013 http://www.asktheeu.org/en/request/622/r... to the document in question. ( see Pt. 3.2 last paragraph).

I would like to request a review of your decision of 19/11/2013 and to grant me access to the document in question and to any other documents I referred in my original request (could be archived in the same place as the document I was refused access). This document exist. Details can be found in Mr Kessler`s Letter where the Document in question is referred as "Note for the Attention of Mrs Catherine Day, Secretary General of the European Commission", incoming references "Transmission of Information THOR (2013)19989".

I would like also to access the Letter of 7 august 2013 mentioned in this document disclosed recently by EC to the public http://www.asktheeu.org/en/request/877/r... (details in letter JUST / ARES 30 SEP. 2013 - 3142128) .

The European Commission has to notify its replies to access to document requests in a way that provides for legal certainty as regards the receipt of the reply by the applicant under Regulation 1049/2001. Replies triggering the possibility for administrative or judicial redress will therefore be transmitted via registered mail with acknowledgement of receipt. This requires an indication of a valid postal address by the applicant.

Moreover, the indication of a postal address is also needed for the correct application of certain other legal aspects (in particular, the scope of possible redress, data protection rules, protection against theft of identity or the use of false identities).

Applicants can, of course, lodge their request for access to documents in electronic form (see also electronic application form at:
http://ec.europa.eu/transparency/regdoc/... ).

Where applicants have also indicated an email address, replies by the Commission will be sent as advanced copy by email in order to ensure that the applicant is informed without delay. Copies of the documents to which access has been granted will usually also be sent by email.
