Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

I'm writing to ask if ESMA has any documentation regarding the number of Suspicious Transaction and Order Reports being filed to the national competent authorities.

Specifically I am looking for :

The number of STORs being sent to NCAs over the past five years
The number of STORs for equity markets being sent to NCAs over the past five years
How many STOR reports are processed and investigated by NCAs every year.
How many STORs lead to further requests for evidence or that require higher levels of examinsation.

If any of my questions are unclear, please let me know.

We would like to refer to the request you submitted to ESMA 14 February 2024 in which you asked to get access to certain documents and numbers relating to "[...] Suspicious Transaction and Order Reports being filed to the national competent authorities".

Against this background, please note that ESMA has published in July 2023 a Report on Suspicious Transaction and Order Reports (STORs) providing an overview over the use of STORs across different jurisdictions. While the report focusses on the years 2021 and 2022, it also provides the aggregated number of STORs received by NCAs as well as a breakdown of STORs submitted per instrument type for the years between 2010 and 2022.

In addition, with respect to your query on NCAs' investigations and follow-up actions, please note that across the 5 years period covering 2018-2022, NCAs have:

- closed 20.018 STORs at initial triage;
- launched 1.545 informal actions (including warning letters, disruptions, etc.) and criminal referrals; and
- started 393 administrative procedures.
