Dear M. Hjertquist,

In reply to your request for information regarding the Directive 2016/2341
(IORP II), we can tell you that the particular exclusion you refer to (in
caption) can be found in the original text of the original Directive
2003/41/EC (IORP I) which already had this exclusion in recital 16, (which
later became recital 28 in IORP II, as recast). This is seen as an
application of the exception in  Article 2(2) point d of IORP II (which is
also copy-pasted from IORP I):  institutions where employees of the
sponsoring undertaking have no legal rights to benefits and where the
sponsoring undertaking can redeem the assets at any time and not
necessarily meet its obligations for payment of retirement benefits. No
further information seems forthcoming.

Dear XUEREB Karen,

Could you please e-mail me to [email address] according to my earlier request.

I would like to know the reason why the Unterstützungskassen where mentioned and excluded in the beginning. There must be an appropriate motion from representatives of Germany or other representatives that mentioned Unterstützungskassen as an entity that should be excluded. I find it highly unlikely that the Commission found this legal entity without further reasoning or mentioning in its legislative work more than just simply stating that a certain type of legal entity would be excluded.
