Total Costs of Ownership for Themis/SIGA project at Curia
Dear Court of Justice of the European Union,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
outline of the full costs of Themis (SYGA or SIGA) project for Electronic Content Management (GED in French) structured by:
commercial of the shelf software,
commercial support,
amount of FTEs,
number and type of individual expert profiles,
name of the suppliers and/or contractors that provided manpower for the project including the call for tender from which they have been sourced.

Pursuant to Article 8 (5) of the Decision of 26 November 2019 concerning
public access to documents held by the Court of Justice of the European
Union in the exercise of its administrative functions (OJ 2020 C 45/2),
the authority empowered to decide (competent authority) has asked us to
notify you the following reply to your request No 0020/2022D:
The implementation of an integrated adaptive case management IT solution
(‘SIGA’) for the Court of Justice of the European Union has been awarded
by means of a contract concluded on the 25^th November 2020.
You will find in the following link the contract award notice in which the
total value of the procurement is indicated (30 104 691.00 EUR excluding
VAT), as well as the names of the contractors:

More specifically, the tender specifications include information about
human resources

section 3.4.3.2) and the template for the financial bid specifies the
expected volume of manpower per profile

With regard to the detailed information about the full costs of software
and support, the number of FTEs, and the number and type of individual
experts, it shall be noticed, on the one hand, that the SIGA project is
still ongoing and that information is therefore still not available as it
will depend on the specific contracts and purchase orders which will
actually be concluded with the contractor.
On the other hand, the fixed prices for some elements of the SIGA project
and the unit prices for other elements of this project that shall be
implemented by means of specific contracts or purchase orders are
indicated in the bid of the contractor. Nevertheless, this document falls
within the scope of the exception to access to documents laid down in
Article 3(2), first indent, of the Decision of 26 November 2019, related
to the protection of commercial interests and thus cannot be disclosed.
Indeed, on account of the economic and technical information contained in
the bid, its disclosure would be detrimental to the commercial strategy of
the contractor and could be used to distort competition.
We would like to draw your attention on the fact that you have the right
to submit a confirmatory application within the time limit provided for in
Article 6 of the Decision of 26 November 2019 as cited above upon receipt
of this reply. A form for this purpose is available on the Institution’s
website.

Dear ms. Sereis,
It is to be assumed from your answer that the costs with the SIGA project would have started after the award of the 2020/S 241-595030 Contract award notice in December 2020.
Would you stated with certainty that there were no previous prototypes for which software purchases were made or FTE were used prior to this date for the same Integrated Case Management project or its earlier versions (prototypes or attempts) ?
If so, please disclose these earlier costs and the previous years when resources started being consumed.
Equally kindly list the approved subcontractors of the two winning companies (Charles Oakes & Co SARL and NET Service S.p.A.) in case subcontracting to other companies or freelancers was granted.

Dear Acces aux documents administratifs,
The Special Report 14: Performance review of case management at the Court of Justice of the European Union drafted by ECA in 2017 ( https://www.eca.europa.eu/lists/ecadocum... ) already mentions a Electronic Content Management project.
So there must have been internal civil servants from the CJEU along with studies, prototypes, external consultants, software purchases associated to ECM (SIGA) ever since 2017, prior to the tender from 2020.
So please communicate the costs between 2017 and 2020 (included) related Electronic Content Management project.
The number of internal FTEs (civil servants of the Court) working on this project is not related to protection of any commercial interests or private contractors, but rather to consumption of salaries paid from taxpayers money.

It's been a bit more than 3 weeks since the lat reply.
Would you have found any relevant documents (even anonymised) related to the expenses incurred by the project Themis (or SIGA or ECM - Electronic Content Management or GED - Gestion Electronique des Documents) at the Court
between the time of the ECA report (August 2017) and before the Call for Tender (COJ-PROC-18/026) awarded in December 2020 ?
