TRIPs waiver
Dear Trade,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
(i) a list of meetings of DG Trade officials and/or representatives (including the Commissioner and his Cabinet) and representatives of the World Trade Organisation (WTO), Medicines San Frontiers (MSF) and the EFPIA (including Vaccines Europe) since June 1, 2021.
(ii) minutes and other reports of these meetings;
(iii) all correspondence (including emails) between DG Trade officials and/or representatives (including the Commissioner and Cabinet) and representatives of the World Trade Organisation (WTO), Medicines San Frontiers (MSF) and the EFPIA (including Vaccines Europe) regarding the proposed TRIPs waiver since June 1, 2021.
I would be grateful if you could take the Code of Good Administrative Behaviour into account when considering (i) of this request.

We refer to your e-mail of 15 December 2021 in which you make a request
for access to documents, registered on 15 December 2021 under the above
mentioned reference number.
The description given in your application does not enable us to identify
concrete documents, which would correspond to your request.
In your request, you asked for the following:
(i) a list of meetings of DG Trade officials and/or
representatives (including the Commissioner and his Cabinet) and
representatives of the World Trade Organisation (WTO), Medicines San
Frontiers (MSF) and the EFPIA (including Vaccines Europe) since June 1,
2021.
(ii) minutes and other reports of these meetings;
(iii) all correspondence (including emails) between DG Trade
officials and/or representatives (including the Commissioner and Cabinet)
and representatives of the World Trade Organisation (WTO), Medicines San
Frontiers (MSF) and the EFPIA (including Vaccines Europe) regarding the
proposed TRIPs waiver since June 1, 2021.
In the third paragraph of your request you refer to the ‘proposed TRIPS
waiver’. Can we assume that the first two paragraphs of your request
equally refer and limit the request to the TRIPS waiver, i.e. are to be
read as ‘ (i) a list of meetings (…) regarding the proposed TRIPS waiver’
and ‘(ii) minutes and other reports of these meetings regarding the
proposed TRIPS waiver’ ?
We therefore invite you, in accordance with Article 6(2) of Regulation
(EC) No 1049/2001 regarding public access to documents, to provide us with
more detailed information on the documents you request. Please note that
we haven’t received an answer to this request within 5 working days (i.e.
03 January 2022 COB, in line with the closing of the European Commission
between the holidays), we will not be able to further process your request
and will close the file.

Dear Madam,
We refer to your e-mail of 15 December 2021 in which you make a request
for access to documents, registered on 15 December 2021 under the above
mentioned reference number.
Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires on 14 January 2022.
An extended time limit is needed as the application concerns documents
held by different Services, which must be consulted.
Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 04 February
2022.
We apologise for this delay and for any inconvenience this may cause.
