VELA 10 and VELA 11

Thank you for your reply to my access to documents request GESTDEM 2020/3617.

While it would seem only natural that EU institutions respect the deadlines of Regulation 1049/2001, unfortunately it has been my experience that a reply within 15 working days is the exception instead of the rule. EU institutions very often extend the deadline, or even miss it by weeks or sometimes months. It therefore should also be commended when a reply is answered within the 15 working days. Swift replies to access to documents request help boost a citizen's confidence in the institution's commitment to transparency.

As to the content of the reply, I have yet to scrutinize the documents and therefore keep the option open to file a confirmatory application within 15 working days, as is my right. But I wanted to send this message of appreciation in the meantime.

Thanks again for your timely reply to my access to documents request GESTDEM 2020/3617.

After scrutinising the documents I notice that most of them relate to a delay caused by the Covid19 pandemic. However, it is my understanding that in 2019 there had already been a delay of the works, and that VELA 10 and VELA 11 were expected to be ready in that year.

Before I file a confirmatory application, I would like to give the JRC the opportunity to find any documents relating to that initial 'pre-corona' delay as part of my original request. If you are able to reply by 23 July - when my right to a confirmatory application expires - I may be able to forego filing a confirmatory application.

Thank you for your e-mail of 10 July 2020.

 

In the JRC news release of 10 October 2018, it was mentioned that the
completion of the civil works for the new building to host the VELA 10/11
facilities was expected for February 2019. This building phase was
followed by the installation of the testing equipment, facility checks and
commissioning which meant the project would be completed by 2020.

The contract for the VELA testing laboratories was signed in September
2018 and foresaw finalisation of the facility construction works in June
2020, and the full delivery including commissioning and acceptance of the
laboratories by 18 December 2020, as can be seen in the contractor’s work
program that you have already received (document 1). This planning would
have been respected without the lockdown due to the Covid-19.

 

Please note that my answer is just for clarification and does not relate
to the procedure to access documents. Particularly, it does not modify the
delay to send a confirmatory application.
