Please pass this on to the person who reviews confirmatory applications.

I am filing the following confirmatory application with regards to my access to documents request which I sent on September 10, 2018, via the AsktheEU platform. I asked for :
- All documents, including but not limited to emails, presentations, reports, minutes, verbatim reports, instructions, non-papers, summaries, related to the decision to create the video posted on Twitter by president Donald Tusk on 6 September 2018, https://twitter.com/eucopresident/status...
- All documents related to the costs of the video, including, if applicable, any contracts

The General Secretariat of the Council of the EU replied the day after - which is commendable - but said that it possessed no documents concerning the video. I find this somewhat difficult to believe, given that the video was made in-house. Were no emails sent between staff before and during the production process of this video? Were there no written instructions? This seems unlikely.

Thank you for your message of 12 September 2018 sent via asktheu.org.

 

As your first request concerned a video production for communication
purposes, the Transparency Team treated it initially as a request for
information not falling under Regulation 1049/2001, and consequently
forwarded it to the Public Information Service of the General Secretariat
of the Council. You received a reply from that service on 11 September
2018. However, following your request of 12th September, the Transparency
service realised that dispatching your initial request to the Public Info
Service was an error due to an internal  misunderstanding.

 

We would like to apologise for this inconvenience and will treat your
application of 10 September 2018 as an initial request under Regulation
1049/2001. The General Secretariat of the Council will proceed with
internal consultations in order to assess your request on the basis of the
applicable rules. You will receive a reply within 15 working days from the
day of your first application, that is by 1 October 2018.
