Mathias Schindler

Dear COSGROVE Orna(EASA),

thank you for your letter. In it, you invite me to find a fair solution under Article 6(3) of Regulation 1049/2001.

In this context, I would like to bring your attention to the European Commission Guidance Note on Wide-Scope initial requests for access to documents.

You have failed with the parameters of this guidance note in several ways, including the fact that such conference should take place as soon as possible after the application has been registered.

The next crucial part is this one:

"The institution should provide the applicant with concrete elements enabling the latter to
take an informed decision, in particular:
- a list of documents or of categories of documents;
- an estimation of their total number and if possible the total of number of pages
covered;
- the estimated number and/or category(ies) of documents that could be dealt with
within 30 working days;
- the estimated time needed to deal with the remaining parts of the application"

You are therefor invited to amend your request for finding a fair solution by providing me a list of documents or of categories of documents falling within the scope of this request in order to allow me to make a fair proposal.

Your deadline for a reply was set to June 26, noon. I think it is reasonable to expect the same from you.

Yours sincerely,

Mathias Schindler

Dear Mr Schindler,

Thank you for your e-mail dated 25 June 2020.

EASA has indicated to you that your request of 08 June 2020, relates to a
large number of documents and therefore, you were invited to specify the
objective of your request, your specific interest in the requested
documents, and to narrow down the scope of your request so as to reduce it
to a more manageable amount of documents. As it was mentioned in our
communication the aim of this request was to propose a fair solution in
order to allow the Agency to retrieve and assess properly and on time all
the requested information.

In order to complete our letter of today’s morning, please note that EASA
– from a quick research under the reference “Palantir” - has identified
mainly two categories of documents: i) Procurement related documents, and
ii) Specific programme related documents. However, this would require the
Agency to look into more than 50 terra byte of data.

Therefore please understand that without any additional clarifications on
the scope of your request, the Agency will probably not be in a position
to further process it.

In order for you to further clarify your request and allow the Agency to
then assess it, we hereby inform you that the deadline laid down by
Regulation (EC) No 1049/2001 is extended by 15 working days. For this
reason you will receive a final reply on your request within 30 working
days from the day of the receipt/registration of the initial application.

Yours sincerely,

Dear ROSTREN Stephanie,

thank you for your explanation. As part of a fair solution, I propose that EASA is going to provide a list of documents identified by the search "Palantir" and I will afterwards indicate which document I would like to have released. Such an approach should not be incompatible with larger amounts of documents.

Yours sincerely,

Mathias Schindler
