As responsible for the European Forest Fire Information System (EFFIS) of
the JRC, which contains the data you are requesting in your email of Nov.
10, I would like to point out some specificities of the access to these
EFFIS datasets.
National "individual fire event data" are held and maintained in the EFFIS
European Fire Database, but are not property of JRC. On behalf of the
National Forest Fire Authorities we could provide you with the data you
are requesting, with the previous agreement of these Authorities. A
simple email with be enough for us.
I would suggest that you contact the responsible of the Spanish forest
fire database at the Spanish Forest Fire Service (Ministerio de Medio
Ambient, Rural y Marino) Ms. Elsa Enriquez, and request this. We will
then be glad to provide you with the data. For the request, please follow
the standard EFFIS data request form that you can find
at [1]http://effis.jrc.ec.europa.eu/data

Thank you for your response.
I thought the information can be accesed even if it was not property of the JRC based on the Regulation (EC) No 1049/2001 of the European Parliament and of the Council that states in its article 2.3:
"This Regulation shall apply to all documents held by an institution, that is to say, documents drawn up or received by it and in its possession, in all areas of activity of the European Union"
If a prior agreement should be given by a member state I think it is the JRC responsability to ask for that authorization.
The standard EFFIS data request form asks for a purpose of the request and on the contrary the Aarhus agreement states:
"Any person' right: the right of access extends to any person, without his or her having to prove or state an interest or a reason for requesting the information."
Please help me with this clarifications.

Further to our message of 19 December 2011 we would like to inform you that we have received the reply of the Spanish National Forest Fire Authorities concerning the release of the information to which you would like to receive the access. The Spanish National Forest Fire Authorities (the owner of the information) did not object to the release, however, they suggested that the most efficient way to deal with your request would be to contact the Área de Defensa contra Incendios Forestales. To this end, we would propose that you contact Mrs Elsa Enríquez (who is in copy of this message) from Área de Defensa contra Incendios Forestales to specify the exact scope of the information you are interested in, so that you would receive the data best fitting your needs/objectives. Given that it was Área de Defensa contra Incendios Forestales that collected, processed and analysed the information in question, it will be more competent to provide you with the assistance relating to your enquiry.
We arranged that the reply to your request can be provided in English.
