Dear Sir,
We refer to your email dated 2 July 2024 wherein you make a request for access to
documents pursuant to Regulation (EC) No 1049/2001 of the European Parliament and of
the Council of 30 May 2001 regarding public access to European Parliament, Council and
Commission documents (hereinafter ‘Regulation 1049/2001’), registered on the same date
under the abovementioned reference number. We also refer to our holding reply, dated 23
July 2024, our reference Ares(2024)5324564, whereby we informed you that the time limit
for handling your application was extended by 15 working days pursuant to Article 7(3) of
Regulation 1049/2001.
Your application reads as follows:

All documents—including but not limited to correspondence, emails, minutes, notes (hand
written or electronic), audio or video recordings, verbatim reports, operational
conclusions, lines to take, briefings, and presentations—related to the meeting on 2021-
01-15 between Fabrice Comptour (Cabinet member of Thierry Breton) and Google.[…]΄΄

We regret to inform you that neither DG CONNECT, nor the archives of Cabinet of ex-
Commissioner Breton hold any documents corresponding to the description given in your
application.
As specified in Article 2(3) of Regulation (EC) No 1049/2001, the right of access as
defined in that regulation applies only to existing documents in the possession of the
institution.
Given that no such documents, corresponding to the description given in your application,
are held by the Commission, the Commission is not in a position to fulfil your request.
In accordance with Article 7(2) of Regulation 1049/2001, you are entitled to make a
confirmatory application requesting the Commission to review this position.
Such confirmatory application should be addressed within 15 working days upon receipt
of this letter to the Secretariat-General of the Commission. You can submit it in one of the
