Your application for access to documents – GESTDEM 2022/1744 
We  refer  to  your  e-mail  of  23  March  2022  in  which  you  make  a  request  for  access  to 
documents, registered on 24 March 2022 under the above-mentioned reference number. 
We regret to inform you that the Directorate General for Energy (DG ENER) does not hold any 
documents that would correspond to the description given in your application.  
Please note that our Directorate General is not in charge of the Communication on sustainable 
carbon cycles nor of the work on the future certification system of carbon removals. We have 
not received correspondence requiring our action on these topics. When mentioned in meetings, 
we  consistently  refer  these  issues  to  our  colleagues  in  the  Directorate  General  for  Climate 
Action (DG CLIMA), who lead on both files. However we would like to point out that we have 
not received meeting requests where the topics you mentioned were listed. 
As specified in Article 2(3) of Regulation (EC) No 1049/2001, the right of access as defined 
in that regulation applies only to existing documents in the possession of the institution.  
Given  that  no  such  documents,  corresponding  to  the  description  given  in  your  application, 
are held by DG ENER, we are not in a position to fulfil your request. 
In accordance with Article 7(2) of Regulation (EC) No 1049/2001, you are entitled to make a 
confirmatory application requesting the Commission to review this position.
