Dear Sir or Madam,

I refer to my request for public access to documents concerning European Union-funded water and sanitation programmes in Bolivia, registered by the European Commission on 9 May 2026 under reference 2026/2414.

Pursuant to Article 8 of Regulation (EC) No 1049/2001, I hereby submit this confirmatory application requesting a review of the implied refusal arising from the absence of a final decision within the statutory time limits.

1. Background

My original application sought access to administrative documentation concerning three European Union financing agreements related to water and sanitation programmes in Bolivia, namely:

LA/2017/390-223;
LA/2019/410-047;
LA/2019/409-406.

The request concerned, among other documents:

Financing Agreements;
Action Documents;
Project fiches;
implementation documentation;
monitoring frameworks;
Results-Oriented Monitoring (ROM) reports;
implementation reports;
financial management documentation; and
documents concerning the financing arrangements of those programmes.

On 29 May 2026, DG INTPA informed me that the time limit for replying would be extended pursuant to Article 7(3) of Regulation (EC) No 1049/2001 because the request concerned documents held by different Commission services that required consultation.

The extended deadline expired on 19 June 2026.

To date, I have not received any final decision.

2. Nature of the requested documents

The documents requested concern the implementation, financing, monitoring and evaluation of European Union development cooperation programmes.

They are administrative documents relating to the management of EU-funded projects.

My request did not seek access to investigative material or documents relating to criminal proceedings, but rather to documentation concerning the implementation, financing, monitoring and institutional oversight of publicly funded development programmes.

3. Public interest

The requested documents concern projects financed through European Union public funds for water and sanitation programmes in Bolivia.

Transparency regarding the financing, implementation, monitoring and evaluation of those programmes serves an important public interest for both European taxpayers and the intended beneficiaries of those programmes.

This interest is particularly significant where the programmes concern access to water and sanitation, services that are essential to the fulfilment of fundamental social needs and to the objectives of the European Union's development cooperation policy.

The request also relates to programmes connected with a sector that has subsequently been the subject of significant public scrutiny and judicial proceedings in Bolivia.

The purpose of this application is therefore to promote transparency and accountability regarding the management of European Union development cooperation funds, rather than to obtain access to material capable of undermining any protected interest.

4. Partial access

Should any of the requested documents fall within one or more of the exceptions provided for in Article 4 of Regulation (EC) No 1049/2001, I respectfully request that partial access be granted in accordance with Article 4(6) of the Regulation.

Likewise, should any part of my request require clarification or narrowing, I remain fully available to assist the Commission in accordance with Article 6(2) of Regulation (EC) No 1049/2001.

5. Request

In light of the above, I respectfully request that the Commission:

(a) review the implied refusal arising from the absence of a decision within the statutory time limits, in accordance with Article 8 of Regulation (EC) No 1049/2001;

(b) adopt a formal decision on my request for access to documents without further delay;

(c) grant access, in full or in part, to the requested documents;

(d) where access is refused, identify the applicable exception under Regulation (EC) No 1049/2001 and explain how that exception applies to the categories of documents requested;

(e) where applicable, indicate whether consultations with other Commission services or third parties were carried out during the handling of the request and whether those consultations affected the Commission's final decision.

Where disclosure cannot be granted, I would respectfully appreciate sufficient reasoning to enable me to understand the legal basis for the refusal and to exercise my rights under Regulation (EC) No 1049/2001.

After a preliminary review of the material provided, I would appreciate clarification regarding several aspects of my original application.

Regarding Financing Agreement LA/2019/409-406, I received only summary information referring to the instrument and its disbursements. I could not identify the Financing Agreement itself, the related Action Document, or any implementation, monitoring or evaluation documentation corresponding to this agreement.

Regarding Financing Agreement LA/2017/390-223, I received the Delegation Agreement and related annexes and amendments. However, I could not identify implementation reports, monitoring reports or Results-Oriented Monitoring (ROM) reports relating to this agreement.

Regarding Financing Agreement LA/2019/410-047, I appreciate receiving the External Mid-Term Evaluation. However, this document is distinct from the Results-Oriented Monitoring (ROM) reports specifically requested. Could you kindly confirm whether any ROM reports exist for this agreement and, if so, provide access to them?

Could you also clarify whether the above categories of documents:

do not exist;
were identified but withheld; or
were not included in the documentation transmitted on 9 July 2026,

and whether a search was carried out specifically in relation to each of the three financing agreements identified in my application.

Finally, I note that the documents were transmitted without indicating which parts of my application had been granted, partially granted or refused. I hereby submit this confirmatory application pursuant to Article 7(2) of Regulation (EC) No 1049/2001, requesting a review of the position expressed by DG INTPA in its initial reply concerning my application for access to documents registered under reference EASE 2026/2414.

I appreciate the documentation disclosed by DG INTPA. Following a careful review of the material received, however, I respectfully consider that the initial reply does not fully address my original application of 9 May 2026 and does not clearly establish whether all requested categories of documents were identified, assessed and decided upon.

1. Background

My original application requested access to documents relating to the following European Union financing instruments concerning water and sanitation programmes in Bolivia:

Delegation Agreement LA/2017/390-223;
Contribution Agreement LA/2019/410-047; and
Financing Agreement LA/2019/409-406.

The request covered, among other categories:

Financing Agreements;
Delegation Agreements;
Action Documents;
implementation documentation;
monitoring documentation;
Results-Oriented Monitoring (ROM) reports;
implementation reports;
evaluations;
financial management documentation; and
documents concerning the financing arrangements of those programmes.

DG INTPA disclosed several documents, including the principal agreements, amendments and, in the case of Agreement LA/2019/410-047, an External Mid-Term Evaluation.

I appreciate that disclosure.

However, after comparing the documents received with the scope of my original application, I remain uncertain whether all documents falling within that scope were identified and assessed.

The purpose of this confirmatory application is therefore not to challenge the disclosure already made, but to request a review of whether my original application was examined in its entirety and whether a complete decision was adopted in respect of each category of documents requested.

2. Financing Agreement LA/2019/409-406

The documentation disclosed in relation to this financing agreement appears particularly limited.

The material received consists essentially of financial summaries and disbursement information.

I did not receive the Financing Agreement itself, nor any Action Document, implementation documentation, monitoring documentation or evaluation reports relating to this financing instrument.

I therefore respectfully request that the Secretariat-General verify whether documentation relating to Financing Agreement LA/2019/409-406 was identified during the handling of my application.

If such documentation exists, I respectfully request that it be disclosed.

If no such documentation was identified, or if access has been refused, I respectfully request that this be expressly confirmed together with the applicable legal basis under Article 4 of Regulation (EC) No 1049/2001.

3. Delegation Agreement LA/2017/390-223

I acknowledge receipt of the Delegation Agreement, its annexes and subsequent amendments.

The Agreement establishes reporting obligations towards the European Commission, including annual management declarations and audit-related documentation.

I therefore respectfully request confirmation as to whether documentation generated in fulfilment of those reporting obligations was identified during the processing of my application.

If such documentation exists and falls within the scope of my original request, I respectfully request its disclosure or, where access is refused, identification of the applicable exception under Article 4 of Regulation (EC) No 1049/2001.

4. Contribution Agreement LA/2019/410-047

I appreciate having received the External Mid-Term Evaluation relating to this Agreement.

In addition, the Contribution Agreement also provides for annual reporting and management assurance documentation to be submitted to the European Commission.

I therefore respectfully request confirmation as to whether documentation generated pursuant to those reporting obligations was identified during the processing of my application.

Furthermore, I respectfully request confirmation as to whether Results-Oriented Monitoring (ROM) reports exist separately from the External Mid-Term Evaluation.

Should such documents exist, I respectfully request that they be disclosed.

If no such documents exist, I would appreciate confirmation of that fact.

5. Completeness of the search

My principal concern is not necessarily that particular documents were withheld.

Rather, DG INTPA's reply does not explain:

which categories of documents requested were identified;
whether certain categories of documents do not exist;
whether additional documents were identified but withheld pursuant to Article 4 of Regulation (EC) No 1049/2001; or
whether certain requested categories fell outside the scope of the searches carried out.

Consequently, it is not possible for the applicant to determine whether the apparent absence of certain categories of documents reflects:

that no such documents exist;
that no such documents were identified; or
that documents were identified but access was refused.
6. Absence of a complete decision

While DG INTPA disclosed a number of documents, the initial reply did not specify, in relation to the categories identified in my original application:

which requests had been fully granted;
which had been partially granted;
whether any categories of documents had been refused;
whether additional documents had been identified but withheld; or
the legal basis for any refusal.

Such clarification is essential to enable the applicant to understand the scope of the search carried out and, where appropriate, to exercise the rights provided by Regulation (EC) No 1049/2001.

7. Request

In light of the above, I respectfully request that the Secretariat-General:

(a) carry out a confirmatory review of DG INTPA's handling of my application;

(b) verify that a complete search was conducted for all categories of documents requested in my original application;

(c) confirm whether additional documentation relating to Financing Agreement LA/2019/409-406 was identified and, where appropriate, disclose it or indicate the applicable exception under Article 4 of Regulation (EC) No 1049/2001;

(d) confirm whether reporting documentation generated pursuant to the reporting obligations established under Delegation Agreement LA/2017/390-223 was identified and, where appropriate, disclose it;

(e) confirm whether reporting documentation and Results-Oriented Monitoring (ROM) reports relating to Contribution Agreement LA/2019/410-047 were identified and, where appropriate, disclose them;

(f) adopt a complete confirmatory decision indicating, in relation to each category of documents covered by my original application, whether access has been granted, partially granted or refused, together with the legal basis for any refusal.
