AMIF documents concerning Poland and Hungary
Dear Directorate E of Migration and Home Affairs,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting access to the following documents:
- Last 2 AMIF Annual Performance Reports submitted by Poland and Hungary*, along with EC observation letters**, if available.
- Composition and rules of procedure of the Hungarian monitoring committee responsible for AMIF funds for the MFF 2021-2027***, which is not available on the website of the relevant Managing Authority
Legislative references:
* Art. 35 (1) Regulation (EU) 2021/1147: "By 15 February 2023 and by 15 February of each subsequent year up to and including 2031, Member States shall submit to the Commission an annual performance report as referred to in Article 41(7) of Regulation (EU) 2021/1060".
** Art. 35 (3) Regulation (EU) 2021/1147: "The Commission may provide observations on annual performance reports within two months of the date of their receipt. Where the Commission does not provide observations by that deadline, the report shall be deemed to have been accepted".
*** Art. 38 Regulation (EU) 2021/1060 : "(1) Each Member State shall set up a committee to monitor the implementation of the programme (‘monitoring committee’), after consulting the managing authority, within 3 months of the date of notification to the Member State concerned of the decision approving the programme. (...) (4) The rules of procedure of the monitoring committee and the data and information shared with the monitoring committee shall be published on the website referred to in Article 49(1), without prejudice to Article 69(5)."
