Article 77d paragraph 4 of Solvency II
Dear European Parliament,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting the following documents:
Any and all documents and information pertaining to the legislative change of the first sentence of paragraph 4 in Article 77d of Directive 2009/138/EC of the European Parliament and of the Council of 25 November 2009 (Solvency II) concerning the volatility adjustment, as has been agreed on 1 April 2019 in the inter-institutional negotiations between the Parliament and the Council with respect to Commission's Proposal for a DIRECTIVE OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL amending Directive 2014/65/EU on markets in financial instruments and Directive 2009/138/EC on the taking-up and pursuit of the business of Insurance and Reinsurance (Solvency II), COM(2017) 537 final, including, but not limited to, any relevant document, proposal, report, minutes, consultation process, stakeholders' input or any other information relating to the above provision (e.g., relevant discussions within the Council of the European Union, the European Parliament, the European Commission, the European Insurance and Occupational Pensions Authority (EIOPA) and with stakeholders etc.).

Dear Ms Theodoropoulou,
In reply to your application A(2019)15053, Parliament examined the
documents it holds and identify a number of documents that are relevant
application and hereby discloses them all, in application of Regulation
(EC) No 1049/2001 on public access to documents. Please find them
attached to this email. The issue of the volatility adjustment in Article
77d Solvency II was raised, discussed and decided upon only in the very
last Trilogue meeting of 21 March 2019. For that reason, there is no
reference thereto in any of the multicolumn tables. It was inserted
directly into the final text for the Coreper.
