Average working days until reply on A2D requests

Alexander Fanta made this access to documents request to Secretariat General of the European Commission Automatic anti-spam measures are in place for this older request. Please let us know if a further response is expected or if you are having trouble responding.

Secretariat General of the European Commission did not have the information requested.

Dear Secretariat General of the European Commission,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting information on the time it has taken the Commission to reply to access to documents requests under Regulation 1049/2001. Specifically, I would like to ask for the following:

- What was the average duration (in working days) for the Commission to take a decision on an initial request for public access in the years 2018-2023? What was the median?
- What was the average duration (in working days) for the Commission to take a decision on a confirmatory request in the years 2018-2023? What was the median?

I note that figures for the year 2021 were already provided by the Commission in its reply on 28 March 2023 to the Ombudsman's strategic inquiry on delays to access requests (OI/2/2022/MIG). I further note that such a request for information may be based on recent jurisprudence, including Dufour v ECB T-436/09; Typke v Commission C-491/15P; Izuzuqyiza & Semsrott v Frontex T-31/18; and Kedrion v EMA T-520/20.

Yours faithfully,

Alexander Fanta
