On 27 March, you have informed me that you had "prepared a fair solution proposal along with a list of the identified documents", and that you only had to "review this list", which you would send me "early next week".

On 16 April you "sincerely" apologized for the delay, but gave no new indication of when I could expect even the fair solution proposal, let alone the documents themselves. Instead, you now said that you were "still working on the identification of the documents falling under the scope of your request" - even though you had said three weeks prior that you already had "a list of the identified documents", which merely needed to be reviewed.

It is now 2 May 2025, and I still have not received anything.

Had I immediately filed a confirmatory application on 27 March, the initial deadline for the secretariat-general would have already expired by now, and the (inevitable) extended deadline would have been less than two weeks away.

DG FISMA has effectively put me in a conundrum: continue to wait (based on nothing more than a - honestly hard-to-believe - claim that it is "doing [its] best to come back to you as soon as possible"), or file a confirmatory application now, guaranteeing that I will have to wait another 30 working days.

I have learned the hard way what I should do the next time, but I want to express my extreme dissatisfaction with your handling of my request - and convey that you are very effectively eroding any remaining trust I may have in the Commission's committment to transparency.

I am filing a confirmatory application with regards to my access to documents request registered under case number 2025/0768.

The Commission has denied access to document 9 with reference to Article 4(3), first subparagraph (institution's decision-making process) and Article 4 (1) (a) 4 indent (financial, monetary or economic policy of the Community or a Member State) of Regulation 1049/2001.

However, it has not distinguished between these two articles in the two paragraphs in which the Commission argues that they apply. This makes it difficult for the applicant to understand which argument refers to which article from the Regulation.

That said, let me break down the arguments given.

* "The release of this document carries a significant risk of misleading both the public and the industries regarding the path forward. It will also open the door to speculations."

The Commission does not explain why this risk exists, what type of speculations and how one of the Commission's own documents could lead to a misleading of the public and industries.

It seems the Commission is using an old argument that has already been refuted by the Court.

In De Capitani v Parliament, T-540/15 the Court of Justice stated "the preliminary nature" of information in documents "does not per se justify the application of the exception provided for in the first subparagraph of Article 4(3) of Regulation No 1049/2001, since that provision does not draw a distinction according to the state of progress of the discussions".

Documents containing proposals or possible legislative initiatives, like document 9, are "by [their] nature, intended to be discussed and is not liable to remain unchanged following such discussion", the Court said. It continued: "Public opinion is perfectly capable of understanding that the author of a proposal is likely to amend its content subsequently".

The same can be said for a document that "contains an overview of strategy relating to a potential ban on inducements [..] prepared by FISMA staff for discussion with FISMA senior management". The public will be perfectly capable of understanding that a document with an overview of a strategy does not mean the contents described in them will be the definite way forward. Both the general public, and myself as an experienced journalist "will be fully aware of the preliminary character" of the information in document 9.

* "In particular, disclosing the document could adversely impact the market environment and undermine public confidence in the EU’s management of its financial policies."

It seems that this statement was included to refer to the exception on financial, monetary or economic policy of the Community or a Member State.

It is another hypothetical and non-substantial argument from the Commission's playbook, which has again and again been refuted - not least by the Commission's own secretariat-general in confirmatory applications. Just because documents contain information about the EU's economy or finance, does not mean that making that information public automatically would undermine the protection of the financial, monetary or economic policy of the Community or a Member State.

* "Moreover, since a final decision on the potential ban on inducements has yet to be made, disclosing this document would severely compromise the institution's decision-making process. Transparency must be balanced against the potential harm that such disclosure could cause to the public interest. Without the ability to freely exchange views and explore potential proposals internally, we effectively undermine the staff’s capacity to fulfil their functions."

The Commission arguing that the fact that "a final decision on the potential ban on inducements has yet to be made" plays a role, should be dismissed. A final decision has been made, when the Commission published a proposal that did not include a full ban on inducements. The decision-making process to which these documents relate, has ended. The Commission has adopted a legislative proposal, ending its internal decision-making process leading up to the publication of that proposal.

Otherwise, the Commission could always argue that any potential idea that has not been implemented in law, should remain secret ad infinitum.

As for the ability for staff to "freely exchange views", I refer again to the Court's explanation that in a democracy, public opinion is able to distinguish between views from staff and potential proposals, and the final outcome of a legislative process. The Commission's internal decision-making process will not be harmed by a little bit more transparency.

There is a strong public overriding interest for this document to be made public. On one hand, the Commission has published multiple reasons why a full ban on inducement would be beneficial to consumers.
