CLS Opinion re European Parliament’s involvement in Council meetings discussion Article 7(1)/Hungary
Dear Council of the EU,
On 12 September 2018, pursuant to Article 7(1) TEU, the European Parliament adopted a reasoned proposal inviting the Council to determine whether there is a clear risk of a serious breach by Hungary of the shared values laid down in Article 2 TEU.
It is my understanding that the President of the European Parliament by a letter sent to you on 18 September 2018 (D 314664) has transmitted the reasoned proposal to the Council.
It has since been reported that that the Council Legal Service (CLS) – either before or during the GAC meeting held on 16 October 2018 (3644th Council meeting, doc. 13125/18) – offered its analysis regarding the issue of whether or not the European Parliament can directly take part in the Council Article 7(1) discussions regarding Hungary in the same way the European Commission has been directly involved in the Council Article 7(1) discussions, in particular the two Article 7(1) hearings organised to date, regarding the situation in Poland.
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting access to:
- the opinion of the CLS described above;
- any document produced by the CLS or the Council itself regarding the “next procedural steps” mentioned in the Council conclusions of 16 October 2018 (doc. 13125/18).

Could you please confirm that there is no Council Legal Service opinion meeting the description I offered in my initial request?
I do have to ask you again as this contradicts what was reported in the press. See for instance Eszter Zalan, ‘EU action on Hungary and Poland drowns in procedure’, 13 November 2018, https://euobserver.com/political/143359:
"The EU council's legal team has said the parliament has no role in council meetings, so the member states decided to hear from the rapporteur outside of the council format. Sargentini argued that the European parliament should have a role in the procedure on Hungary as it was the institution that triggered the Article 7 sanctions procedure"
The document which you sent me predates by a few months the opinion of the Council Legal Service referred to above and which would have been (allegedly) given at some point in November.
