Communications from Member States on future ERDF Operational Programmes

Response to this request is long overdue. By law, under all circumstances, Regional and Urban Policy should have responded by now (details). You can complain by requesting an internal review.

Dear DG Regio

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting copies of documents (reports, communications, memos, etc.) received during 2012 to date from each or any of the governments of Bulgaria, Hungary, Romania and Slovakia which refer to the development of ERDF Operational Programmes for the period 2014-2020. In particular I am interested in recent documents which indicate the current status of planning and negotiations at the national level.

I also request access to any documents received during 2012 to date from the governments of Bulgaria, Hungary, Romania and Slovakia which refer to the development of the Partnership Contracts. In particular I am interested in documents which refer to the partners who have been or who will be included in the development of the Partnership Contracts and/or the future Operational Programmes.

Should you have multiple documents which respond to the above request, please do not hesitate to contact me to narrow the request.

I would prefer to receive the requested documents in electronic format and ideally in machine-readable format.

With regard to the request you have made for access to documents, we
inform you that for the time being there are no documents which refer to
the development of ERDF Operational Programmes for the period 2014-2020 or
the Partnership contracts, since the formal negotiating process will only
start in early 2013. Thus, we would like to advise you to make a new
request for access to documents at a later stage.

Dear Mrs. Darbishire,
 
In your e-mail dated 29 November 2012, you requested copies of documents
received during 2012 to date from the governments of Slovakia, which
relate to the development of ERDF Operational Programmes and Partnership
Agreement for the period 2014-2020.
 
In case of Slovakia, up to date, we have not received officially any
documents from the Slovak government related to the preparation of the
Partnership Agreement and Operational Programmes for the next programming
period. There have been delays on the part of the Slovak authorities in
preparing the next programming period and discussion is still on-going on
the SK side. To follow up on the discussion at the national level,
documents available so far can be accessed from the following websites:

Dear Ms Darbishire,
 
Thank you for your query. Regarding the documents you wish to access with
reference to the negotiations on the future programming period, I wish to
give you the following information.
 
As you appreciate, the entire programming procedure and related
negotiations are a complex and lengthy procedure whereby numerous
documents of different nature are produced.  Some are only for internal
use (at the level of the directorate, the Directorate-General for Regional
and Urban Policy or the different Commission services) some are shared
with the Member State's relevant services and some are entirely public. We
would need to know exactly what document you wish to receive, preferably
with references (type of document, date, services, participants involved,
etc.).
 
Regarding the Partnership Agreement you make reference to, I inform you,
that it has not yet been submitted to the Commission services. No
information has yet been received on the procedure, timing and
technicalities of the involvement of partners either. Both information and
documents will probably be available in the first half of 2013.
Nevertheless, regarding the draft Partnership Agreement (prior to its
adoption foreseen by the end of 2013), restrictions as described in
Article 4 of Regulation (EC) No 1049/2001  may apply.
