Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting responses to the multi-stakeholder consultation FUTURE-PROOF AI ACT: TRUSTWORTHY GENERAL-PURPOSE AI, which closed on 18 September 2024.

Thank you for your response.

I would like to note that the identification of these documents has already occurred, meaning that no further identification step is needed.

However, I am willing to compromise and limit the scope of my request just to the 22 GPAI provider documents that are present in the consultation that have already been identified.

This fair solution takes into account the specific factors you have mentioned above. Firstly, I do not ask for retrieval of the documents beyond those that have been identified or those uploaded through the CNECT system referred to in our request. So do not include those that require scanning. Secondly, I note that all entities answering the online survey or uploading documents to it agreed explicitly that "All contributions to this consultation may be made publicly available." before uploading (verbatim text from the consultation). It is therefore implausible that the grounds of refusal in Article 4 of 2001/2049 would meaningfully apply, because Article 4(4) of that Regulation states that the Commission shall not contact the third-party if it is 'clear that the document shall... be disclosed.'. Therefore there is no third party consultations needed there and frankly, no preliminary individual assessment, and no assessment in light of those comments, and no redaction required.

(I understand that this would not apply if we chose, for example, the 11 documents from public authorities, which would generate more workload.) As a result, I believe that asking for the 22 GPAI provider documents is a fair solution.

Please provide all 22 GPAI provider documents.
