We refer to your e-mail of 9 February 2021 in which you make a request for access to
documents, registered on 10 February 2021 under the above-mentioned reference
number.
You request access to all correspondence (including reports, official letters, emails,
databases, attachments, minutes and meeting reports, as well as any other type of public
document not mentioned in the previous list) sent or received by DG MOVE with
Spanish authorities (Ministry of Development, Ministry of Transport, national ports, the
Port Authority of Gijón, the principality of Asturias) from 1 January, 2014 until today on
the subject of the Motorways of the Sea link between the ports of Gijón and Nantes.
We refer to the letter Ares(2015)5179418 of 18/11/2015 in which DG MOVE has already
provided you with a list of documents covering the period of June 2014 – September
2015.
We regret to inform you that the Commission does not hold any documents that would
correspond to the description given in your application covering the period of September
2015 up to the present.
As specified in Article 2(3) of Regulation (EC) No 1049/2001, the right of access as
defined in that regulation applies only to existing documents in the possession of the
institution.
Given that no such documents, corresponding to the description given in your
application, are held by the Commission, the Commission is not in a position to fulfil
your request.
In accordance with Article 7(2) of Regulation (EC) No 1049/2001, you are entitled to make
a confirmatory application requesting the Commission to review this position.

Such a confirmatory application should be addressed within 15 working days upon receipt
