Council discussions on country by country reporting
Dear Council of the EU,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting all agendas; minutes / notes of discussions; position papers; and any other documents relating to Council deliberations on the 'Proposal for Directive of the European Parliament and the Council amending Directive 2013/34/EU as regards disclousure of income tax information by certain undertakings and branches', which is also known as country by country reporting.

I am filing the following confirmatory application with regards to my access to documents request 'Council discussions on country by country reporting'.
Thank you for the documents provided, but I was disappointed that the following were not made available:

WK 12193/17: Explanatory Note on the Presidency compromise proposal in doc. 13685/17 - 27/10/2017

WK 14969/17 REV 1: Presidency NOTE on the subject - 08/01/2018
WK 10931/17: Delegations comments received after the Working Party meeting on 20 of September 2017 - 06/10/2017
It is not clear to me why "Release to the public of the information contained in them would severely affect the negotiating process and diminish the chances of the Council reaching an agreement", and I would like you to reconsider. In particular, I note that the European Ombudsman has recently asked the Council to publish far more documents of this type:

For example she says:
"The documents disclosing the positions of the Member States should, in principle, be made proactively and directly available to the public in a timely manner. Any refusal to release the name of a Member State, which should be rare, needs to be based on the duly reasoned application of an exception listed under Article 4 of Regulation 1049/2001 and be consistent with the case-law."
She further notes that the Court of Justice of the EU has found that: “[i]f citizens are to be able to exercise their democratic rights, they must be in a position to follow in detail the decision-making process within the institutions taking part in the legislative procedures and to have access to all relevant information. The identification of the Member State delegations which submit proposals at the stage of the initial discussions does not appear liable to prevent those delegations from being able to take those discussions into consideration so as to present new proposals if their initial proposals no longer reflect their positions. By its nature, a proposal is designed to be discussed, whether it be anonymous or not, not to remain unchanged following that discussion if the identity of its author is known. Public opinion is perfectly capable of understanding that the author of a proposal is likely to amend its content subsequently”.
In addition I would point out that country-by-country reporting is a file of importance and of public interest, concerning transparency of taxes paid by multinational corporations. I hope that you will agree that there should be transparency of decision-making on such matters.
