‒ Préparation du trilogue
I.
Contexte
Les contacts entre colégislateurs concernant les négociations sur la proposition de modification du
règlement SIS en objet ont été réactivés après l'accord politique sur la proposition de modification
du règlement Europol.
Un certain nombre de réunions tripartites informelles et un trilogue technique ont été organisés afin
de finaliser une proposition de texte de compromis. Les délégations ont été tenues informées du
déroulement des négociations lors des réunions du groupe de travail sur l’échange d’informations
dans le domaine de la JAI (IXIM).

Les négociateurs du Parlement et du Conseil, assistés par les représentants de la Commission, se
sont concertés au niveau technique sur une proposition de compromis révisée qui est présentée en
annexe sous la forme d’un tableau quatre colonnes. Cette proposition de compromis est en attente
de validation au niveau politique.
II.
Proposition de compromis
La proposition de compromis sur le texte SIS en annexe intègre tous les éléments clés du mandat de
négociation sur la proposition SIS approuvé par le Comité des représentants permanents (Coreper)
le 13 octobre 2021

La proposition de compromis inclut notamment la création d’un nouveau type de signalement, le
signalement informatif concernant les ressortissants de pays tiers dans l'intérêt de l'Union (ci-après
‘signalement informatif’), sans aucun lien avec le territoire des États membres.
Il est proposé qu’Europol joue un rôle clé dans l'analyse et la vérification de toutes les informations
fournies par les pays tiers et les organisations internationales avant leur enregistrement dans le SIS.
Europol aidera les États membres à traiter les données de pays tiers et fera des propositions sur
l'enregistrement éventuel de signalements informatifs. Toutefois, seuls les États membres seront
autorisés a introduire des signalements informatifs dans le SIS. Les États membres auront en plus le
pouvoir discrétionnaire d'émettre d'autres types de signalements une fois qu'ils auront reçu une
proposition d'Europol.
Les concessions et améliorations que comporte le texte de compromis par rapport au mandat du
Conseil se trouvent dans les considérants, dans les garanties visant à assurer que les informations
sont traitées dans le plein respect des droits de l'homme et qu'elles peuvent être corrigées dans les
cas où Europol dispose de nouveaux éléments de preuve, dans les dispositions visant à garantir
qu'Europol reçoit systématiquement des informations en cas de réponse positive (‘hit’), et dans les
dispositions visant les informations à fournir à la Commission pour une évaluation de l'efficacité
des signalements informatifs et un rapport en la matière.

La présidence a pu constater lors de la réunion du groupe de travail IXIM du 25 février dernier que
les délégations soutenaient l’approche de la présidence
2 dans sa globalité, n’ayant exprimé qu’un
nombre limité d’observations techniques ou de réserves d'examen qui n’ont pas été jugées de nature
à bloquer les travaux.
III.
Préparation du trilogue
À la lumière de ce qui précède, le Comité des représentants permanents est invité à valider les
compromis proposés par la présidence et repris dans le tableau figurant à l'annexe de la
présente note afin de conclure les négociations sur le dossier législatif lors du prochain
trilogue politique.
