CSAR trilogue documents and age verification assessments
Dear European Parliament,
Under the right of access to documents in the EU treaties, as developed in Regulation (EC) No 1049/2001, I am requesting documents which contain the following information:
1. LIBE Committee trilogue documents
All working documents, rapporteur notes, shadow rapporteur notes, compromise amendment texts, and inter-institutional correspondence relating to trilogue negotiations on the proposed Regulation laying down rules to prevent and combat child sexual abuse (COM(2022) 209), produced or received after 26 November 2025.
2. Legal compatibility assessments
Any opinions, notes, or assessments produced by the European Parliament Legal Service or the LIBE Committee Secretariat concerning the compatibility of the revised Council position on COM(2022) 209 as adopted by COREPER on 26 November 2025, with:
(a) The Charter of Fundamental Rights of the European Union, specifically Articles 7, 8, and 52(1); and
(b) The Council of Europe Framework Convention on Artificial Intelligence, Human Rights, Democracy and Rule of Law, as ratified by the European Parliament on 11 March 2026.
3. Age verification assessments
Any documents, briefings, impact assessments, or correspondence held by the European Parliament — including by the LIBE Committee, its Secretariat, or the EP Legal Service — referencing or assessing:
(a) The mandatory age verification obligations introduced by the revised Council position on COM(2022) 209 as adopted by COREPER on 26 November 2025; and/or
(b) Security incidents involving age verification or identity verification vendors, including but not limited to incidents involving Discord/5CA (October 2025), Persona Identities Inc. (February 2026), and AU10TIX (2022-2024).
There exists an overriding public interest in the disclosure of the requested documents within the meaning of Article 4 of Regulation (EC) No 1049/2001. That interest is specific and concrete, and arises from the following considerations:
First, it is necessary to ensure that the measures proposed by the Commission in COM(2022) 209, and the subsequent compromise position adopted by COREPER on 26 November 2025, are consistent with the principles of essence and proportionality as required by Article 52(1) of the Charter of Fundamental Rights — in particular with respect to the right to privacy and protection of personal data under Articles 7 and 8 of the Charter — and with the secondary legislative framework governing data protection and fraud prevention, including Regulation (EU) 2016/679 (GDPR) and applicable fraud liability directives.
Second, it is necessary to validate, through an evidence-based approach, whether the measures proposed — in particular mandatory age verification obligations — are consistent with the technical reality of currently implemented and planned verification systems, including documented security incidents affecting identity data, and with the reactive behavioural patterns empirically observed in response to such measures, including platform migration and circumvention by the populations the measures are designed to protect.
Third, it is necessary to determine whether all available alternative measures have been appropriately considered in the legislative process, in accordance with the principle that any interference with fundamental rights must employ the least intrusive means capable of achieving the stated objective. This consideration is of particular urgency given that trilogue negotiations on a permanent framework are active and a legislative outcome may be reached before the next opportunity for democratic scrutiny.
