Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
On May 17, 2023, a citizen requested documents of the Council of the European Union, the request was registered as 23/1517-mj-adb and concerns documents 8833/23 and/or 8787/23.
I would like to request all information in all form- temporary or otherwise, important or otherwise - concerning the handling of this access to documents request, including internal memoranda, drafts, legal assessment etc.

Please pass this on to the person who reviews confirmatory applications.
I am filing the following confirmatory application with regards to my access to documents request 'Documents concerning access to documents request Ref 23/1517mj-adb/el'.
There is reason to assume that not all documents within the scope of my request were released. The Council claims that a "careful assessment" of the documents within the scope of the request 23/1517mj-adb/el" was made, yet no documents stemming from this assessment were released. This runs contrary to any proper administrative work.
Council should stop using an arbitrarily narrow definition of what constitutes a document under Regulation 1049/2001 that seems to include notes, drafts and internal exchanges of documents or parts thereof.

Dear Fernando Florindo,
thank you for your letter dated August 7, 2023 in which you state that you like to extend the deadline for handling my confirmatory application. You base this extension on Article 8 (2) of the Regulation which states:
"2. In exceptional cases, for example in the event of an application relating to a very long document or to a very large number of documents, the time limit provided for in paragraph 1 may be extended by 15 working days, provided that the applicant is notified in advance and that detailed reasons are given."
The requirements for such an extension are not met. You don't even pretend to claim that this is an exceptional case. On the contrary, the reason provided by you is "summer". A season is the most anti-exceptional thing there is. It is the answer to "Tell me a thing that happens regularly and predictably?". The Council has had 22 years now to make up its mind about assigning someone to take care of matters in case COREPER wants to spend its time outside of Brussels.
Your request for an extension of the deadline is denied. You failed to meet the requirements of Article 8(2) of Regulation 1049/2001 and you may resume working on my confirmatory application within the time limits prescribed by the Regulation. You may do so in the sun or in the shade.
