Documents concerning tender awarded by ECHA
Dear European Chemicals Agency,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information, in relation to the tender ECHA/2024/OP/0004 (links to the TED Notice views added below) - from now on "the Project":
- List of all contractors and subcontractors involved in the Project;
- Terms of References signed by contractors and subcontractors (or any other contract signed by the parties containing details of the work they will perform as part of the Project);
For each Project contractor:
- Conflict of interest assessment performed by the European Union in relation to said contractor;
- Declaration on Conflict of interest submitted by said contractor (or on behalf of said contractor) to the European Union.
For each subcontractor:
- Conflict of interest assessment performed by the European Union in relation to said subcontractor;
- Declaration on Conflict of interest submitted by said subcontractor (or on behalf of said subcontractor) to the European Union.
- All correspondence, including attachments (i.e. any emails, mail correspondence or telephone call notes) between the European Chemical Agency (ECHA) and one or more of the Project contractors and/or subcontractors, concerning the Project
- All reports and studies (including drafts) prepared by the Project contractors and/or subcontractors and submitted to the ECHA
- Minutes and/or notes of any meeting (in relation to the Project, including online meetings) between one or more of the Project contractors and/or subcontractors and the ECHA,
- Allocation of the project budget across contractors and subcontractors.

We hereby refer to your application for access to documents under
Regulation (EC) No 1049/2001, which has been registered on 4 February 2025
under reference ATD/008/2025.
In your request, you seek access to documents in relation to the tender
ECHA/2024/OP/0004 which contain the following information, in relation to
the tender ECHA/2024/OP/0004 (links to the TED Notice views added below) -
from now on "the Project":

Unfortunately, the reference to and description of “the Project” given in
your application does not enable us to identify concretely the scope of
documents which would correspond to your request.
Could you please specify, having regards to the type of procurement
procedure and contract signed under the four lots, what you are referring
to.
Please note that, as set out in the Management Board decision on the
implementation of Regulation (EC) No 1049/2001 in ECHA ([1]MB/12/2008
final), the deadline for replying to your request will run only from the
time we have received your clarification.
We would appreciate receiving the clarification of your application by
Wednesday 19 February 2025.
If we do not hear from you within the above timeframe, your request will
be closed, and it will not be further processed.
