Documents from 01 January 2023 to 09 June 2023 in relation to GDPR Article 96
Dear European Data Protection Board,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents (including plenary / sub-plenary preparatory documents) that discuss, relate to, or reference GDPR Article 96.
The timeframe for responsive documents would be those produced between 01 January 2023 and the present (09 June 2023).
Yours faithfully,
Nicholas Lee
Dear Sir/Madam,
Thank you for your message and for your interest in data protection.
We will look into your request and get back to you within due time.
Kind regards,
The EDPB secretariat
Dear Mr Lee,
Many thanks for your e-mails.
We have received three different requests from you:
- One request concerning FATCA, received on 8/06 and registered on 13/06 as Case 2023-21.
- One request concerning Article 49 GDPR, received on 9/06 at 16:52h
- One request concerning Article 96 GDPR, received on 9/06 at 16:53h.
At the moment, the EDPB Secretariat is facing a high workload in terms of handling access to documents requests, coupled with limited resources. Due to this, at the moment we are not able to ensure that we will be able to comply with the normal time limits set out in Article 7 of Regulation (EC) No 1049/2001, if the three requests run in parallel. Therefore, in accordance with Article 6(3) of Regulation 1049/2001, we would like to propose as a fair solution that we deal with your two remaining requests once we have dealt with Case 2023-21.
If you agree with this proposal, we will register and handle your other two requests once we have dealt with Case 2023-21.
Please let us know whether the above proposal is acceptable for you.
Best regards,
The EDPB Secretariat
Dear European Data Protection Board,
I would propose the following processing of requests:
1. Case 2023-21, concerning the Belgian DPA decision re: FATCA, according to its existing registration date & timeline
2. My request concerning Article 96, with a registration date of 04/07/2023, one day after the time limit set by EU regulations to process 2023-21.
3. My request concerning Article 49, with a registration date of 27/07/2023.
Those registration dates would allow the requests to be processed sequentially and in line with the normal time limits from the dates of registration.
Yours sincerely,
Nicholas Lee
Dear Mr Lee,
Many thanks for your understanding, we will proceed in that way.
Have a nice day!
Best regards,
The EDPB Secretariat
