Tesla presented its software concept and raised questions about the interactions between the 
Data Act and the planned regulation on Access-to-Vehicle Data. Tesla suggested a carve-out for 
in-vehicle data under the general Data Act requirements. Instead, Tesla suggested a labelling for 
cars that provides higher access to data to inform consumers instead of imposing a 
comprehensive list of minimum data.  

COM clarified that the Data Act establishes the general principles for data-sharing and will be 
applicable to all sectors. Sector-specific legislation will complement but not prevail over the 
general principles of the Data Act. The Data Act was presented by the Commission in February 
2022 following extensive assessments and consultation. 

COM questioned to what extent Tesla is open to collaboration with other OEMs and developers 
on their software stack. Tesla expressed a preference for proprietary solutions, suggesting that 
such collaborations could slow down their agility. Tesla prefers to avoid the use of third-party 
software for security reasons. 

In terms of bidirectional EV charging, Tesla would welcome simplified rules, allowing innovation 
and avoiding fragmentation, but without obligations. 

Tesla also flagged that the new incentive schemes for battery manufacturing in the US (under 
the Inflation Reduction Act) make it relatively unattractive to invest in the EU.
