Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

1) the agenda, minutes and notes produced for / during the meeting of the Working Party on Plant Health (Roosendaal Group) of 2 October 2018 (referenced in CM 4353/18)

2) the list of attendees, agenda, minutes and any notes produced in preparation and during the EU-USA Plant Health Technical Working Group that took place in Brussels on 24 and 25 October 2018 (referenced in CM 4353/18)

3) the agenda, minutes and notes produced for / during the meeting of the Working Party on Plant Health (Roosendaal Group) of 2 October 2018 (referenced in CM 3779/19)

4) the list of attendees, agenda, minutes and any notes produced in preparation and during the EU-USA Plant Health Technical Working Group that took place in Brussels on 1 and 2 October 2019 (referenced in CM 3779/19)

Thank you for your interest in documents of the Council of the European
Union.

 

Regarding your request in general, the General Secretariat of the Council
would like to inform you that access to documents of the Council is
subject to the principles, conditions and limits laid down in Regulation
(EC) No 1049/2001 (OJ L 145, 31.5.2001, p. 43) and the specific provisions
laid down in the Council's rules of procedure (OJ L 325, 11.12.2009, p.
35).

 

In general, access to documents rules establish that the public can have
direct access to documents of the Council when these documents:

•           were issued as public documents,

•           have been made public as a result of a previous request for
access,

•           are older than 30 years (although exceptions apply).

 

If a document is not public, a member of the public can put forward a
request for access. However, the General Secretariat of the Council would
like to draw your attention that Regulation (EC) No 1049/2001 does not
foresee a right of privileged access.

 

This means that when there is a request for access to documents, the
General Secretariat of the Council has to examine each individual document
requested to see if its disclosure to the public would harm any of the
interests protected under the Regulation. Following that examination, the
General Secretariat may decide to refuse access, or agree to the partial
or full disclosure of the requested document. In case of the latter, the
document is then made available to the public through the Council's Public
Register.

 

In view of the above, the General Secretariat strongly advises applicants
for access to documents to narrow down, to the extent possible, their
request. To help you further define your query, may we suggest that you
conduct a search within the Council's public register at:
http://register.consilium.europa.eu/

 

The Council's public register contains references to most Council
documents since 1999 (exceptions may apply regarding classified
documents), of which approximately 75% are public and available for
downloading.

 

By choosing the option "Search", you can search for documents using
several criteria, for example: document number, words in title or text,
subject matter and interinstitutional file number.

 

If you find a document in the register that cannot be directly downloaded
(i.e. marked by a "grey" pdf icon), you may introduce a request for access
by using the available electronic form.

 

You may also conduct a search for documents references by using CASE, the
Central Archives Search Engine. CASE provides access to descriptions of
the archives of the Council of the European Union and it is available at:

Dear Transparency Unit,

Since your last message ten additional working days have passed. While I understand that the current situtation puts stress on all EU institutions, my sympathy for the delay of this particular request is limited.
Kindly note that the initial deadline for my request as per regulation Regulation 1049/2001 expired on 25 February, hence long before the Corona crisis hit Europe.

Please let me know when I can expect the information requested more than two months ago. Should there be any further delay to be expected, please also clarify in which way the present situation has exactly affected your untimely handling of my request.

Thank you for message and please accept, once again, our apologies for the
delay in our final reply.

 

The examination of your request has been facing unusual difficulties,
mostly, because you have not identified any specific documents possibly
listed in the Council's Public Register.

 

In the absence of any references to specific documents, we had to carry
out an in-depth search in the Council's Public Register looking for
documents matching the scope of your request. In addition, the examination
of your request involved, in particular, consultations with the competent
services both within the General Secretariat of the Council and the
European Commission. These consultations allowed us to identify six
working documents (WKs) related to your request. These documents were
drawn up by different Commission Directorates and then circulated to
delegations of EU Member States in their capacity of members of various
preparatory bodies of the Council, notably, the Working Party on Plant
Health ("Roosendaal Group").

 

We would also like to inform you that all the Agendas ("CM" documents) of
the Roosendaal Group are public and the General Secretariat of the Council
does not draw up any reports, minutes or outcome of proceedings of this
Group's meetings, in accordance with the Council's Rules of Procedure
(Council Decision No 2009/937/EU, OJ L 325, 11.12.2009, p. 35).

 

Allow us to draw your attention to the fact that the General Secretariat
of the Council has a legal obligation to carry out an evaluation of each
document's content in order to verify whether its possible disclosure
(total or partial) would harm the interests and values protected by
Article 4 of Regulation 1049/2001.

 

Moreover, it should be noted that the "EU-US Plant Health Technical
Working Group" is not a preparatory body of the Council but rather a forum
managed by the European Commission's Directorate-General for Health and
Food Safety which is responsible for EU policy on plant health and for
monitoring the implementation of related laws, including international
cooperation in this policy area. Please find below several useful links

In order to obtain the missing elements required to complete our

Group" which might be in possession of the Commission services, allows to
