DTCC meetings

We're waiting for Fiona Maxwell to read recent responses and update the status.

Dear European Parliament,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- Dates and times of meetings held with DTCC in the run up to the Emir review (between May and September, inclusive, 2015) in which the subject of Emir reporting was mentioned.

- Minutes and emails relating to all of those meetings.

Dear Ms Maxwell,

in your application under Regulation (EC) no 1049/2001 you request:

"- Dates and times of meetings held with DTCC in the run up to the Emir review (between May and September, inclusive, 2015) in which the subject of Emir reporting was mentioned.
- Minutes and emails relating to all of those meetings."

You will be aware that the European Market Infrastructure Regulation (EMIR) [or Regulation (EU) No 648/2012 of the European Parliament and of the Council of 4 July 2012 on OTC derivatives, central counterparties and trade repositories], foresees under its Article 85(1) that "By 17 August 2015, the Commission shall review and prepare a general report on this Regulation." Article 85(2) specifies the partners co-operating in the exercise. European Parliament is not involved in this phase. However, the "Commission shall submit the report to the European Parliament and the Council, together with any appropriate proposals." Thus, Parliament will be involved only when the Commission will have finished and passed its report on the results of the public consultation.

Depository Trust and Clearing Corporation (DTCC) has replied to the consultation via its subsidiary DTCC Derivatives Repository Ltd. DTCC is registered with European Parliament's and European Commission's Joint Transparency Register (JTR): http://ec.europa.eu/transparencyregister.... DTCC has no staff accredited to the European Parliament. However, they are member of the EPFSF-European Parliament Financial Services Forum (see Fields of interest section).

EPFSF (http://www.epfsf.org/) is not part of the European Parliament; it is a not for profit organization under Belgian law (ASBL). EPFSF consists of "a number of Members of the European Parliament who form a Steering Committee, together with Financial Industry Members and a wide range of leading players in the European financial industry" (http://www.epfsf.org/about/who-we-are). The organisation's principal purposes are:
"- to promote integration of a single European market for financial services across national borders, which is globally competitive and to the benefit of the European economy as well as suppliers and consumers of financial services;
- to provide a focal point and resources for members of the European Parliament interested in financial services issues as well as a forum for industry-Parliamentary dialogue;
- to deploy the joint expertise of its financial industry Members to spread factual information about financial markets and services to the European Parliament via briefs, meetings, study visits and other regular activities as appropriate." (http://www.epfsf.org/about/objectives)
EPFSF organises different types of events and trainings. These are attended by interested MEPs, expert guest speakers from the financial industry, consumer groups, and relevant authorities, regulators and officials. (http://www.epfsf.org/about/who-we-are). EPFSF is registered with the JTR as well: http://ec.europa.eu/transparencyregister... .

Parliament does not hold any documents related to meetings with DTCC in the run up to the EMIR review (May to September 2015). The secretariat of European Parliament's Committee on Economic and Monetary Affairs, the committee that was responsible for the EMIR procedure (see the procedure file: http://www.europarl.europa.eu/oeil/popup...) is not aware of any meeting between bodies of the European Parliament and DTCC in the framework of the EMIR review process.
