On 14 December 2023, the Dutch government informed parliament that it would send the market surveillance authority ILT a notice instructing it not to enforce part of the Dutch law which implements the Single Use Plastics directive.

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

- All internal Commission documents - including but not limited to minutes, (hand-written) notes, reports, audio recordings, verbatim reports, operational conclusions, lines to take, briefings, e-mails, letters, and presentations - related to the Dutch implementation of the Single Use Plastics directive since 1 December 2023.

- All documents - including but not limited to minutes, (hand-written) notes, reports, audio recordings, verbatim reports, operational conclusions, lines to take, briefings, e-mails, letters, and presentations - related to communication between the Dutch government and the European Commission about the Dutch implementation of the the Single Use Plastics directive since 1 July 2023.

Only digital copies are required, please consider the environment by not sending me any physical mail.

I am of course available to clarify my request further if needed.

I am filing the following confirmatory application with regards to my access to documents request EASE 2024/0191.

The Commission says that it was "not able to identify any document based on the description given in your request".

However, it also said that the "evaluation of the Dutch transposition is ongoing", and "not completed". This wording strongly suggests that this evaluation has started, which means that documents falling in the scope of my request must exist and therefore should have been identified.

I also would like to point out that my request would include any communication between the Dutch authorities and the Commission, for example questions sent by the Dutch authorities regarding the implementation and (non-)surveillance of the rules. This communication can exist outside of / in parallel to the evaluation of Dutch transposition.

not yet been able to gather all the elements necessary to carry out a full
