EC Decision/s on withdrawal of several legislative proposals (2025)

We're waiting for Emilio to read a recent response and update the status.

Dear Secretariat General of the European Commission,

On October 6th the Commission has published on the OJ Serie “C” (Communications) a list of withdrawal of several legislative pending proposals without publishing the relevant Commission Decision/s justifying the withdrawals of each one of the proposals at stake. Among these withdrawals decisions one concerns Regulation CE 1049/2001.
According to art.296 TFEU the Commission decision/s “shall state the reasons on which they are based and shall refer to any proposals, initiatives, recommendations, requests or opinions required by the Treaties” and such reasons shall be at the disposal of the EU Citizens and the National Parliaments.

Under the right of access to documents in art.15.3 TFEU , I am requesting access to the withdrawal decision and notably of of the legislative proposal concerning the revision of Regulation n. 1049/2001 on access to EU documents.

In case no explicit Decision exists, I am asking all the relevant, internal documents and exchange of messages justifying the above mentioned withdrawal.

Dear Secretariat General of the European Commission,
Thanks to your reply.

Unfortunately the documents you sent me do not explain the reasons why so many legislative pending procedures have been closed . This is notably the case for the revision of Regulation (EC) 1049/01 which should be updated in the light of the Lisbon Treaty and of the Charter which entered into force in December 2009.
Also in the eyes of EU Citizens and Civil society the EC decision of Closing a legislative procedure is an important decision at least as it is a motivated decision of not launching a new EU legislative procedure (see mutatis mutandis the Client Heart Ruling in Case C‑57/16 P, par.107-109)
Because of this I kindly ask you to disclose in compliance with art 15.2 TFEU the relevant documentation explaining the reasons justifying the withdrawal of the legislative procedures.
In the specific case of the withdrawal of the legislative proposals revising the Regulation (EC) 1049/01 maybe the Commission document SPI(2025)39 cited in the EC Minutes may reply to my request.
