ECHA PFAS lobbying tabled Sept 2024
Dear European Chemicals Agency,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001 and further to my previous requests reference ATD/015/2024 and ATD/061/2024, I would like to request access to the following documents related to lobbying on PFAS, per and polyfluoroalkyl substances. In particular I would like:
1. A list of all meetings/ discussions since 6 June 2024 between officials and businesses, trade associations, or think tanks where this topic was discussed.
2. Any records, minutes, preparatory briefings, or other notes of these meetings/discussions.
3. All correspondence since 6 June 2024, where this topic was discussed, exchanged between officials and businesses, trade associations, or think tanks.
To the extent possible, my strong preference is to receive documents in electronic format.
I would also be grateful to receive the documents in batches, as soon as they are identified and available to send.

I refer to your email dated 12 September 2024 in which you make a request
for access to documents under the above-mentioned reference number under
Regulation (EC) No 1049/2001 on public access to documents (the “ATD
Regulation”). Your request concerns access to documents related to
lobbying on PFAS, per and polyfluoroalkyl substances:
1. A list of all meetings/ discussions since 6 June 2024 between officials
and businesses, trade associations, or think tanks where this topic was
discussed.
2. Any records, minutes, preparatory briefings, or other notes of these
meetings/discussions.
3. All correspondence since 6 June 2024, where this topic was discussed,
exchanged between officials and businesses, trade associations, or think
tanks.
ECHA is committed to treating requests under the Regulation (EC) No
1049/2001 (“ATD Regulation”) within the shortest timeframe possible.
However, your application concerns a large number of documents
(approximately 14), all of them originating from third parties, which need
to be assessed individually.
Such a detailed analysis, together with the need to consult the third
parties concerned in accordance with Article 4(4) of the ATD Regulation,
cannot be carried out within the normal time limits set out in Article 7
of the ATD Regulation.
Article 6(3) of the ATD Regulation provides that in the event of an
application relating to a very long document or to very large number of
documents, the institution concerned may confer with the applicant
informally, with a view to finding a fair solution.
With a view to finding a fair and practical solution, as provided for by
Article 6(3) of ATD Regulation, we would like to propose a disclosure
within maximum two months from your confirmation of this fair solution.
We hope that our proposal regarding the refinement of the timeframe of
disclosure meets your needs.
You are kindly requested to inform us whether you agree to this proposal
as soon as possible and no later than by 08. 10. 2024.
