Dear Sir/Madam,
We are writing concerning your request for access to Commission documents
registered on 25/08/2025 under case number EASE 2025/4291.
In your application, you requested access to documents which contain the
following information:
· Preparatory documents of the EDF Work Programmes of 2021-2025.
This may include for example Commission preparatory documents, documents
from meetings of the Programme Committee, lobbyist meetings or any other
relevant documents on the preparation of the work programmes.
Based on the excessive and inaccurate scope of your request, we are unable
to handle your request based on the description given in it as it stands.
However, Article 6(3) of Regulation (EC) No 1049/2001 provides for the
possibility to confer with an applicant informally with a view to finding
a fair solution when an application relates to a very long document or
concerns a very large number of documents.
In accordance with the case law of the EU Courts, such a solution can only
concern the content, or the number of documents requested, not the
deadline for replying. This means that the scope of the request must be
reduced in a way that would enable its processing within the extended
deadline of 15 + 15 working days.
Based on the above-mentioned provision, we would kindly ask you to specify
the objective of your application and your specific interest in the
documents requested, and narrow down the scope of your application, so as
to reduce it to a more manageable amount of documents.
In this regard, we invite you to send us:
- More detailed information related to the quoting, ‘relevant
documents on the preparation of the work programmes’, e.g. by listing the
documents to be covered by the request, the subject matter(s) and
specified timeframe covered.
- Regarding the documents related to the, quoting, ‘lobbyist
meetings’, we would ask you to clarify the scope of your request and to
list the entities to be covered by your request, including the subject
matter(s) and specified timeframe covered.
To support you in clarification of your request, we provide additional
information about the preparation of the annual EDF Work Programmes. EDF
Work Programmes are defined in close cooperation with the EU Member States
and associated countries (Norway) within the EDF Programme Committee. The
Commission, as provided by Regulation (EC) No 182/2011, keeps a register
of committee proceedings which contains:
(a) a list of committees;
(b) the agendas of committee meetings;
(c) the summary records, together with the lists of the authorities and
organisations to which the persons designated by the Member States to
represent them belong;
(d) the draft implementing acts on which the committees are asked to
deliver an opinion;
(e) the voting results;
(f) the final draft implementing acts following delivery of the opinion
of the committees
(g) information concerning the adoption of the final draft implementing
acts by the Commission;
(h) statistical data on the work of the committees.
The references of all documents referred to in points (a) to (g) of
paragraph as well as the information referred to in (h) is publicly
available on the [1]Comitology Register.
We invite you to refer to the [2]Comitology Register to access
above-mentioned documents.
Similarly, to consult the meetings between the Commission and the interest
representatives, we suggest you to refer to the [3]Transparency
register.
The 15 working days to reply to your request will start running only when
you reply to this message. If you do not reply within 7 working days, we
will close this case in line with our detailed rules for the application
of Regulation (EC) No 1049/2001.
