We would first like to inform you that publicly available information
regarding the EIB operations signed with CIP in the dates indicated in
your message is published on the Bank’s website. This concerns the
operations:

Concerning your request for access to “all correspondence, meeting notes,
emails and records of communication between the European Investment Bank
(EIB) and Copenhagen Infrastructure Partners (CIP) from 1 January 2023 to

transactions. This includes internal EIB notes or minutes summarising such
interactions", please note that the EIB due diligence involves several
different services of the Bank covering the financial, economic,
technical, climate environmental and social aspects of the project, and as
such, the EIB does not keep a unified list of all documents mentioned in
your request. Nor does the EIB necessarily produce internal notes or
minutes of all its interactions with clients.
 
Therefore, should you wish to obtain any particular information regarding
the EIB’s operations with CIP beyond what is published on the Bank’s
website, we would invite you to further specify the type of information
that you would like to obtain in order for the Bank to better identify the
documents or information requested and assess their disclosure in line
with the  provisions of its Transparency Policy Article 5.19 and Article
5.21, EIB-TP .
 
Please also note that, while the EIB is committed to a policy of 
presumption of disclosure and transparency, it also has the duty to 
respect confidentiality in compliance with EU laws, including the
obligation not to disclose information of the kind covered by the 
obligation of professional secrecy in accordance with Article 339 TFEU, as
well as legislation to protect personal data. National regulations and
banking sector standards covering business contracts and market activity

Thank you for your previous response requesting further specification of my access to documents request. I appreciate the need for clarification and have refined my application accordingly.

I refine my request, making the Helax Istmo project (Mexico) the sole and specific subject. This request covers all documents held by the EIB related to its potential financing, direct or indirect, through Copenhagen Infrastructure Partners (CIP), the Global Gateway initiative, or any other financial intermediary, fund, or EIB facility - including Helax Istmo itelf.

I specifically request access to the following documents concerning the Helax Istmo Wind, Solar, and Hydrogen/Desalination complex in Oaxaca, Mexico:

Environmental and Social Due Diligence (ESDD): All internal EIB reports, notes, or summary documents that cover the EIB's evaluation of the Environmental and Social Impacts and Risks associated with the Helax Istmo project. This includes, but is not limited to, assessments concerning:

Land Use and Community Engagement.
Water Resource Management and Pollution Control.
Project Safety and Resilience.
Biodiversity Protection.

Correspondence with Mexican Authorities: All records of communication (emails, letters, meeting minutes, or notes) between the EIB and any relevant Mexican authorities (including federal, state, or local government bodies) regarding the Helax Istmo project, its permits, land agreements, or social consultations.

Financing and Decision Records: All internal EIB documents (minutes, notes, or decision sheets) that confirm or detail the decision to provide financing, guarantees, or investment to the Helax Istmo project, or to the funds/actors financing it.

Fund II , the EIB evaluates the fund manager’s policies, governance, and
environmental, social, and governance (ESG) systems. The Bank does not
conduct Environmental and Social Due Diligence (ESDD) on individual assets
within the fund’s portfolio. Consequently, the EIB does not hold
project-specific documents such as:

 

•            Environmental and social assessments or internal ESDD reports
on Helax Istmo

•            Correspondence with Mexican authorities regarding the project

•            Internal financing or decision documents relating to Helax
Istmo

 

In light of the above, the EIB does not possess, and therefore cannot
disclose , documents falling within the scope of your refined request.
