Dear European Stability Mechanism,

Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:

Αναφέρομαι στην επισύνημμενη έκθεση Ερευνητικής Επιτροπής για την κατάρρευση του συνργατικού κινήματος η οποία δημοσιεύτηκε τον Μάρτιο του 2019.

ΣτΗ σελίδα 431 (και αλλού αναφέρεται ο πρώτος επιτόπιος έλεγχος που πραγματοποίησε ο ΕΕΜ για τον συνεργατισμό το 2015 και στη σελίδα 529 ( και αλλού ) αναφ΄ρεται και δεύτερος επιτόπιος έλεγχος που πραγματοποίθηκε το 2018, σαν αποτέλεσμα του οποίου πολλές υποθήκες του Συνεργατισμού κρίθηκε ότι είχαν μηδενική αξία.

Μπορώ να έχω αντίγραφο των ακόλουθων εγγράφων τα οποία αναφέρθηκαν στις δημόσιες για το κοινό εργασίες και ένορκες καταθέσεις που έλαβαν χώραν ενώπιον της ερευνητικής επίτροπης

(α) το πόρισμα των επιτόπιων εκέγχων του ΕΕΜ που έγιναν το 2015 και το 2018 και

(β) την επιστολή που απέστειλε ο ΕΕΜ στην Επιτροπεία του Συνεργτισμού ή /και τον τότε διευθυντή κύριο Νικόλα Χατζηγιάννη , στην οποία αναφέρθηκε στην ένορκη κατάθεση του ο κ. Χατζηγιάννης κατά την οποία δήλωσε πως ο ΕΕΜ μηδένισετην αξία των ενυπόθηκων εξασφαλίσεων του συνεργατισμού και τους λόγους για τους οποίους κρίθηκε ότι είχαν μηδενική αξία αυτές οι υποθήκες ?

(γ) Τα ερωτημαλόγιο με 21 ερωτήσεις που απάντησε η κυρία Ντάνιελ Νουί στις 27/11/2018 προς την ερευνητική επιτρόπή το οποίο αναφέρεται στη σελίδα 17

είμαι πολίτης της Κυπριακής Δημοκρατίας και χρειάζομα την ενημέρωση που σας ζητώ για προσωπικούς λόγους .

Kindly note the following :
1. EEM is the Greek acronym for ESM
2. I am not asking for the "Investigative Research Committee report on the collapse of the co-op movement/bank", published in March 2019. which is a public document , which I already have in my poesession.
3. I am asking for ESM documents specified in my original request and/or any ESM documrnts mentioned in the above report if possible.
4. I sincerely hope that the the ESM's Managing Director may decide to act upon article 17 and disclose the required documents for the sake of true transparency , especially as those documents are mentioned in an already publicised report and the proceedings of the Investigative Research Committee were open to the public

I would like to clarify the following:

(a)EEM is the Greek acronym for the Europrean Stability Mechanism i.e Ενιαίος Εποπτικός Μηχανισμός

(b) The documents I requested were contained in the "Investigative Research Committee report on the collapse of the co-op movement/bank", published in March 2019 and they were submitted to the Investigative Research Committee by the ESM and /or its president Ms Daniel Nui.

(c) I am not requesting the report on the collapse of the co-op movement/bank published in March 2019 per se. This is a public document which I have in my posession already. I am only looking for all the documents mentioned in my original request which refers to all the documents submitted to the investigative committe by the ESM.

(d) I do hope that the requested documents will be disclosed under article 17 of the by laws of the ESM

(e) In the unfortunete case that the the ESM cannot disclose the requested documents please consider this as a request to redirect my request to tho European Central Bank .
At the time the Central cooperative Bank of Cyprus was under thw suprervision of the European Central Bank and the ESM, given that the ESM is under the juristiction of the ECB which falls under Art. 15 TEU and the EU transparency regulation.

(f) for example, in order to clarify paragraph (e) above I quote tfrom the investigative report regarding the connection between the ECB and the ESM: "2. Σελ. 35

Πριν ο ΕΕΜ αναλάβει την εποπτεία των τραπεζών που θα τίθεντο κάτω από την αρμοδιότητα της ΕΚΤ προχώρησε κατά το 2014, στη διενέργεια
Συνολικής Αξιολόγησης σε όλες τις τράπεζες (σύμφωνα με τις πρόνοιες του σχετικούΚανονισμού (ΕΕ) αριθ. 1024/2013 στου Συμβουλίου της 15/10/2013).
