Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information, all of them spanning from October 2024 until the present day:

- All the correspondence, presentations, videos, reports, membership information, agenda, meeting notes and written communications that relate to an Embassy Working Group established by the EU Delegation in Washington that has discussed EU and US Energy matters, and in particular US LNG trade.

- All the correspondence, reports and written notes produced by Jamie Kern, Policy Officer at the Delegation of the European Union to the United States, that relate to contacts with US corporations and/or Government officials and discuss Energy affairs, in particular US LNG trade.

- All the correspondence, reports, meeting agendas and notes and written notes produced by the EU Delegation in Washington Global Issues and Innovation and Trade and Agriculture teams' members that elaborate on US LNG trade.

The goal of this FOIA is to better understand the topics and positions discussed between the EU Delegation in Washington and US corporations and officials regarding US LNG trade.

We refer to your request for access to documents registered under EEAS
reference 086/2025, in which you ask access, among others, to all
correspondence, reports and written notes produced by Jamie Kern, Policy
Officer at the Delegation of the EU to the United States, that relate to
contacts with US corporations and/or Government officials and discuss
Energy affairs, in particular US LNG trade.

 

We take note that such a request concerns a selected natural person, who
is an EEAS staff member not forming part of the EEAS Senior Management.

 

Please note that the EEAS must ensure a fair balance between the right of
access to documents and the right to the protection of personal data.

 

The identification of any document matching this part of your application
as well as its disclosure would reveal personal data of identified natural
persons. In fact, it should be recalled that the case-law has concluded
that activities of a professional nature are included in the notion of
private life, especially if the information enable an individual to be
identified (VG v Commission, T-314/16 and T-435/16). Article 9(1)(b) of
Regulation (EU) 2018/1725 does not allow the transmission of these
personal data, except if you prove that it is necessary to have the data
transmitted to you for a specific purpose in the public interest and where
the EEAS establishes that it is proportionate to transmit that personal
data for that specific purpose in the public interest and that the data
subject’s legitimate interest would not be compromised. In light of this,
this part of your request, as currently formulated, cannot be accepted by
the institution.

 

Should you wish, you may re-formulate this specific point of your requests
for access to documents by indicating an EEAS entity, for example the
Global Issues and Innovation Section of the EU Delegation to the United
States, instead of a natural person working for the EEAS. As a
consequence, please note that this part of the request may overlap with
other parts of your request.

 

You will receive the reply of the EEAS on your whole request after this
point has been clarified.

In response to your request for clarification regarding the part of my application which refers to a natural person's communications, I would like to decline it. Although in my understanding lobbying activity is usually conducted in a way that certain individuals are approached seeking influence in major decisions —such as the EU's Energy ones—, and therefore the communications with the mentioned individual are in my view of public interest, I believe this time the other part of the request can cover the full of it.
