Dear Tim,

We would like to refer to your request for access to documents submitted
on 04/07/2025 and registered on 04/07/2025 under file number
Ares(2025)5398193.

Since you have not provided a postal address, we have not yet been able to
start processing your application. The 15-working day period for
processing your application starts as soon as you provide us with your
postal address. You can reply to this email to provide us with your
mailing address. If we do not receive an answer, we reserve the right to
close the case.

We need your postal address to register and process your request for
access to documents if you have submitted it by email due to:

• The correct application of the Data Protection Regulation (EU)
2018/1725. In order to decide which terms of use apply to the transfer
of personal data to the applicant, it is necessary to determine
whether the applicant is a resident of the EU or not. These conditions
for recipients established in the Union are different from those for
recipients in third countries. As the majority of the documents
requested contain personal data, EFCA cannot ensure the correct
application of data protection rules in the absence of a postal
address.
• The correct application of the Regulation (EC) No 1049/2001. Article
4(1)(b) of this Regulation refers to the protection of the privacy and
integrity of individuals and is to be applied in accordance with the
Data Protection Regulation.
• To protect the interests of citizens and to protect the principle of
sound administration. EFCA treat all citizens equally by ensuring that
the legal framework for public access to documents is respected.

These considerations make it clear that it is not only appropriate, but
even indispensable, to request and process a postal address of the
applicant in order to enable EFCA to carry out a task in the public
interest within the meaning of Article 5(1)(a) of the Data Protection
Regulation, namely to provide rapid and effective access to documents.

Kind regards,

EFCA Communications

Tim Schauenberg
