Info, European Union Satellite Centre

Dear Mr. Lasenberg,

Thank you for contacting SatCen with this important request!

As provided by Article 15 (3) of the Treaty on the Functioning of the
European Union (TFEU), “each institution, body, office or agency shall
ensure that its proceedings are transparent and shall elaborate in its own
Rules of Procedure specific provisions regarding access to its documents,
in accordance with the regulations referred to in the second
subparagraph”.

It stems also from Article 16 of the Council Decision 2014/401/CFSP of 26
June 2014 on the European Union Satellite Centre and repealing Joint
Action 2001/555/CFSP on the establishment of a European Union Satellite
Centre (SatCen),
hereinafter “the Council Decision”, that upon a proposal by the Director,
the Board shall adopt rules on public access to the documents of SATCEN,
taking into account the principles and limits laid down in Regulation (EC)
No 1049/2001 of the European Parliament and of the Council.

SatCen has adopted rules on public access to documents, which can be
consulted at the following address:
 [1]https://www.satcen.europa.eu/keydocument...

In accordance with Art6, c) of such decision, SatCen products, as defined
in Article 2 of the Council Decision, are developed and provided in
accordance with the Agency’s mission, exclusively for institutional
authorized users,
under the exclusive operational direction of the High Representative of
the European Union for Foreign Affairs and Security Policy.

Public access to SatCen’s products, by the nature of said products, would
undermine the protection of the public interest with respect to public
security, defence and military matters and international relations under
Article 6(b) (i) of the Rules regarding public access SatCen documents,
consequently, any requests to access shall be refused.

Following this rules, we therefore regret that we are unable to comply
with your request.

Best regards,

EU SatCen
