Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
Any and all information, including any travaux préparatoire, written exchange, emails with other DGs or any institutions of the Energy Community, including any briefs, analysis or other documents, prior to or, at any time, after the 42nd Permanent High Level Group meeting in Vienna with relation to or having any reference to the document entitled 'European Commission, Non-paper on competition policy in the Energy Community: Supporting actions' or any of its content, in particular but not limited to the expressed Commission view:
"It would be at odds with this comprehensive approach to develop a separate energy
specific approach. Ultimately it would risk duplicating efforts and at worse it could lead
to diverging positions with the existing procedures in the Contracting Parties and EU
competition policy enforcement/ state aid control."

Dear Mr Gecic,
We refer to your e-mail of 17 November 2021 in which you make a request
for access to documents, registered on 17 November 2021 under the above
mentioned reference number. Your application is currently being handled.
However, we will not be in a position to complete the handling of your
application within the time limit of 15 working days, which expires on 08
December 2021.
An extended time limit is needed as the application concerns documents
held by different Services, which must be consulted.
Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 07 January 2022.
We apologize for this delay and for any inconvenience this may cause.
