Farewell reception costs for the European Ombudsman
Dear European Ombudsman,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001, I am requesting documents which contain the following information:
The Brussels news organisation, Politico, is making a mention of "farewell reception of the European Ombudsman".

We refer to your e-mail of 26 September 2024, by which you requested
public access to documents. In the acknowledgement of receipt we sent you
on 26 September 2024, we informed you that we would reply to you no later
than 17 October 2024 (15 working days from the date of registration of
your request).
Your application is currently being handled. However, we will not be in a
position to complete the handling of your application within the time
limit of 15 working days, which expires tomorrow.
An extended time limit is needed as internal consultations are still
ongoing.
Therefore, we have to extend the time limit with 15 working days in
accordance with Article 7(3) of Regulation (EC) No 1049/2001 regarding
public access to documents. The new time limit expires on 7 November 2024
though we will do our best to revert to you as soon as possible.

Dear Mr Thorgen,
By e-mail of 26 September 2024, you requested public access to documents
concerning the farewell reception of the European Ombudsman held on 25
September 2024. In particular, you wished to receive documents relating to
the "full costs for the venue, music, transport, drinks and food or
dinners for the guests".
On 25 September 2024, the European Ombudsman held its annual stakeholder
event in Brussels. Around 300 stakeholders were invited to mark the end of
the current Ombudsman's mandate after 11 years and to reflect on past and
future challenges for the EU administration. The invitees included
representatives from civil society and academia, journalists, members of
the European Network of Ombudsmen as well as representatives from the EU
institutions, bodies and agencies.
Your request was registered on 26 September 2024 under reference number
Ares(2024)6804798.
By e-mail of 16 October 2024, we informed you about the extension of the
deadline for our reply by 15 working days with a view to concluding our
internal consultations.
We have dealt with your request in accordance with Regulation
1049/2001[1][1] regarding public access to European Parliament, Council
and Commission documents as well as the Decision of the European Ombudsman
on the handling of requests for public access to documents[2][2].
We have identified 39 documents as falling within the scope of your
request. We have decided to grant you partial access to the documents thus
identified. We have redacted these documents with a view to protecting (i)
personal data in accordance with Article 4(1)(b) of Regulation 1049/2001
and with Regulation 1725/2018[3][3], and (ii) commercial interests of a
legal person in accordance with the first indent of Article 4(2) of
Regulation 1049/2001.
According to Article 4(1)(b) of Regulation 1049/2001, access to a document
(or parts thereof) shall be refused if its disclosure would undermine the
protection of privacy and the integrity of the individual. Article 3(1) of
Regulation 1725/2018 states that personal data means “any information
relating to an identified or identifiable natural person [...]”.
For the sake of completeness, it should be added that, pursuant to
Article 9(1)(b) of Regulation 1725/2018, personal data shall only be
transmitted to recipients established in the Union other than Union
institutions and bodies if “the recipient demonstrates that it is
necessary for the data to be transmitted for a specific purpose of public
interest and the controller, where there is reason to assume that the
legitimate interests of the data subject might be prejudiced, demonstrates
that it is proportionate to transmit the personal data for that specific
purpose after a demonstrable assessment of the various conflicting
interests”. You would thus need to demonstrate the necessity of having the
personal data transferred for a specific purpose in the public interest
and show that there is no reason to assume that the legitimate interests
of the data subjects would be prejudiced[4][4]. We have not identified
this to be the case here.
Some parts of the documents contain also information on the companies'
unit pricing. Since this information is not publicly available, we have
redacted those documents with a view to protecting the commercial
interests of the companies concerned in line with Article 4(2), first
indent of Regulation 1049/2001.
Should you wish to challenge this decision, you may request a review under
Article 7(2) of Regulation 1049/2001 (‘confirmatory application’
procedure). You may do so by sending an e-mail to

decision. Our Secretariat-General would then handle the review request.
