You request access to:

 

 1. The final report of project 745810- TORERO
 2. Any communication between CINEA and the project's coordinator
ArcelorMittal related to the Torero project between the inauguration
of the plant in December 2023 and today.

 

With regard to your request n.2 “access to any communication between CINEA
and the project’s coordinator […] between […] December 2023 and today”, we
regret to inform you that no formal communication has taken place during
that range of time.

 

We consider that the following document falls within the scope of the
request:

 

• Final Report of the Horizon 2020 project 745810- TORERO
(H2020-LCE-2016-RES-IA) (Document 1)

 

After examining this document in accordance with the provisions of
Regulation (EC) 1049/2001 regarding public access to documents, we regret
to inform you that your application cannot be granted, as disclosure is
prevented by the following exception to the right of access laid down in
Article 4 of this Regulation:

 

• Article 4(3) first paragraph of Regulation 1049/2001 provides that
“access to a document, drawn up by an institution for internal use or
received by an institution, which relates to a matter where the
decision has not been taken by the institution, shall be refused if
disclosure of the document would seriously undermine the institution's
decision-making process, unless there is an overriding public interest
in disclosure.”

 

The document to which you seek access is currently under assessment of the
granting Authority. Thus, there is a need to protect the ongoing
decision-making process of the Agency, so that it can be finalised without
any external interference.

 

The exception laid down in Article 4(3) first subparagraph of Regulation
1049/2001 apply, unless there is an overriding public interest in the
disclosure of documents. Such an interest must firstly be of a public
nature and, secondly, outweigh the harm caused by the
disclosure. According to established EU case law (1), an overriding public
interest must normally be something specific and substantiated. In your
application, you did not put forward any concrete evidence which could
indicate the existence of such an overriding public interest in the sense
of the Regulation that would outweigh the need to protect the
above-mentioned interests of the consortium.

In accordance with Article 4(6) of the Regulation, we have considered the
possibility of granting partial access to the abovementioned document but,
unfortunately, no meaningful partial access is possible without
undermining the interests described above.

 

The document to which you seek access contains personal data in the
meaning of Article 3 (1) of Regulation (EU) 2018/1725 (the EU Data
Protection Regulation EUDPR), such as names, positions, professional
experience of the natural persons involved in the project.

 

To sum up, the exceptions laid down in Article 4(3) first paragraph and
Article 4(2) first indent of Regulation 1049/2001 apply, unless there is
an overriding public interest in the disclosure of documents. Such an
interest must firstly be of a public nature and, secondly, outweigh the
harm caused by the disclosure. According to established EU case law
(Judgment of the Court of Justice of 21 September 2010, Sweden and others
v API and Commission, C-514/07 P, C-528/07 P and C-532/07 P,
ECLI:EU:C:2010:541), an overriding public interest must normally be
something specific and substantiated.

In your application, you did not put forward any concrete evidence which
could indicate the existence of such an overriding public interest in the
sense of the Regulation that would outweigh the need to protect the
above-mentioned interests of the consortia. Moreover, Article 9(1)(b) of
the EUDPR requires that the necessity to have the personal data
transmitted must be established by the recipient (i.e. applicant of the
access to documents request) and it does not allow the transmission of
these personal data where there is reason to assume that the legitimate
interests of the data subject might be prejudiced.

 

In accordance with Article 4(6) of the Regulation, we have considered the
possibility of granting partial access to the requested document; but
unfortunately, no meaningful further access is possible without
undermining the interests described above.

 

In accordance with Article 7(2) of Regulation 1049/2001, you are entitled
to make a confirmatory application as regards your request for access to
documents requesting the Agency to review this position.

 

Such a confirmatory application should be addressed within 15 working days
