I.
INTRODUCTION
1. On 30 May 2018, the Commission submitted the abovementioned proposal to the European
Parliament and the Council.

2. The Union fisheries control system is mainly set out in three Council regulations: (1) on the
Union control system for fisheries of 2009 ("control regulation")
3; (2) on illegal, unreported
and unregulated fishing of 2008 (“IUU regulation”)
4; and (3) on the European Fisheries
Control Agency (EFCA) of 2019 (“EFCA regulation”)
5. Some other regulations contain
additional specific rules relating to fisheries control.

3. The Commission proposal amending these regulations envisages the first major revision of
the Union fisheries control system since its last reform in 2009. Most amendments relate to
the revision of the control regulation. A key objective of the reform is the creation of a more
effective and efficient fisheries control system through improved, simplified and modernised
rules, procedures and instruments.
4. The European Economic and Social Committee delivered its opinion on 12 December
2018
7. The European Committee of the Regions decided on 1 October 2018 not to issue an
opinion.
5. The European Parliament adopted amendments to the Commission proposal on 11 March
2021 and referred the matter back to the PECH Committee for inter-institutional
negotiations

which was adopted, during the Portuguese Presidency, on 28 June 2021.

II. INTERINSTITUTIONAL NEGOTIATIONS
7. The Slovenian Presidency started inter-institutional negotiations with the European
Parliament in July 2021. Between July and late November 2021, 11 inter-institutional
technical meetings and three political trilogues were held. The Presidency debriefed Coreper
on the outcome of these trilogues on 8 September, 20 October and 19 November 2021
respectively. The Presidency also debriefed the Working Party on Fisheries Policy regularly
on the progress made in inter-institutional technical meetings. The last inter-institutional
technical meeting under the Slovenian Presidency is scheduled on 3 December and the last
trilogue on 7 December.
8. The institutions agreed to divide the Commission proposal into 19 thematic “sequences” and
to address those in the order of their numbering (see Annex 3). The numbering was chosen
with a view to facilitate negotiations. Between July and late November 2021, the institutions
intensively discussed sequences 1, 2, 3, 5 and part of sequence 6. The European Parliament
repeatedly postponed negotiations on sequence 4 due to ongoing internal discussions. It has
recently indicated that it might be ready to exchange views on sequence 4 in the trilogue on
7 December 2021.
9. Negotiations proved to be most intensive on the composition of the Administrative Board of
EFCA and the definitions of and approach to fishing and catching vessels. It became
increasingly obvious that granting the Parliament a seat on EFCA’s Administrative Board,
together with aligning the EFCA Regulation with horizontal rules on decentralised
agencies
10, would allow agreeing on numerous other provisions, including the topic of
fishing and catching vessels. As for the IUU regulation, the European Parliament accepted
all changes proposed in the General Approach.
III. PREPARATION OF THE NEXT TRILOGUE
10. To prepare the trilogue of 7 December, the Presidency presented, on 25 November, to the
Working Party on Fisheries Policy its suggested mandate on sequences 1 to 6, with a focus

on sequences 1, 2, 3 and 5
11, which was widely supported by delegations. On 29 November,
the Presidency presented a slightly revised version of the suggested mandate
12, taking into
account oral and written comments of several delegations
13, during a meeting of
Councellors/Attachés on Fisheries Policy. This revised Presidency’s proposal for a mandate
is set out in Annexes 1 and 2 to this note
14.
11. On the basis of this mandate, the Presidency will in principle defend the Council's General
Approach for most of the provisions. However, the Presidency seeks to have some flexibility
to address some of the European Parliament's most important concerns and to accept several
compromise texts prepared during the inter-institutional negotiations and acceptable to the
European Parliament and the Commission, as follows:
a) On the EFCA regulation (‘sequence 1’):
i.
to accept the proposed compromise texts relating to the objectives, definitions
and mission of the Agency set out in Annex 1 (Articles 1, 2 and 3 EFCA
Regulation
15);
ii.
to accept that the European Parliament appoints one representative without
the right to vote to EFCA’s Administrative Board (Article 33(1) EFCA
Regulation
16);
iii.
to align various provisions related to the adoption of EFCA’s programming
documents to horizontal rules applicable to decentralised agencies (Articles
24(3), 25, 32(2)(c), 38(3)(a) and 48(1)
17);
b) On definitions of the control regulation (‘sequence 2’):
i.
to accept a corrected definition of the term ‘multiannual plans’ (Article 4(24)
of the control regulation)

c) On licences and authorisations set out in the control regulation (‘sequence 3’):
i.
to agree to refer to ‘towing and auxiliary vessels’ in the definition of ‘fishing
vessel’ and to grant flexibility to further explore how to refer to aquaculture
vessels (Article 4(31) of the control regulation

24), as well as flexibility to explore using
terminology and approaches proposed by the Parliament on some elements of
the proposal (Article 54d)

e) On the IUU Regulation, in particular, IT CATCH - digital management of catch
certificates (‘sequence 5’):

to accept various changes that address errors and omissions in the
Commission’s proposal, in particular, relating to ‘exportation’(Articles 12(5),
12a(1) and 54a)

III. CONCLUSIONS
12. The Permanent Representatives Committee is invited to enable the Presidency to conduct
negotiations with the European Parliament and to:
- endorse the Presidency's suggested mandate for sequences 1 to 6 as set out in
Annexes 1 and 2 to this note;
- indicate flexibilities in relation to issues as presented in point 11 of this note.
