Follow up PFAS lobbying ECHA
Dear European Chemicals Agency,
Under the right of access to documents in the EU treaties, as developed in Regulation 1049/2001 and further to my request of 26 January 2024 reference ATD/015/2024, I would like to request access to the following documents related to lobbying on PFAS, per and polyfluoroalkyl substances. In particular I would like:
1. A list of all meetings/ discussions since 26 January 2024 between officials and businesses, trade associations, or think tanks where this topic was discussed.
2. Any records, minutes, preparatory briefings, or other notes of these meetings/discussions.
3. All correspondence since 26 January 2024, where this topic was discussed, exchanged between officials and businesses, trade associations, or think tanks.
To the extent possible, my strong preference is to receive documents in electronic format.
I would also be grateful to receive the documents in batches, as soon as they are identified and available to send.
Thank you in advance and for the documents supplied for ATD/015/2024.
Yours faithfully,
Vicky Cann

Dear Vicky Cann,
Thank you for your below message dated 6 June 2024.
We hereby acknowledge receipt of your application for access to documents under Regulation (EC) No 1049/2001, which has been registered on 10 June 2024 under reference ATD/061/2024.
Best regards,

Dear Ms. Cann,
I refer to your email dated 6 June 2024 in which you make a request for
access to documents under the above-mentioned reference number. Your
request concerns access to documents related to lobbying on PFAS, per and
polyfluoroalkyl substances:
1. A list of all meetings/ discussions since 26 January 2022 between
officials and businesses, trade associations, or think tanks where this
topic was discussed.
2. Any records, minutes, preparatory briefings, or other notes of these
meetings/discussions.
3. All correspondence since 26 January 2022, where this topic was
discussed, exchanged between officials and businesses, trade associations,
or think tanks.
ECHA is committed to treating requests under the Regulation (EC) No
1049/2001 (“ATD Regulation”) within the shortest timeframe possible.
However, your application concerns a large number of documents
(approximately 26), most of them originating from third parties, which
need to be assessed individually.
Such a detailed analysis, together with the need to consult the third
parties concerned in accordance with Article 4(4) of the ATD Regulation,
cannot be carried out within the normal time limits set out in Article 7
of the ATD Regulation.
Article 6(3) of the ATD Regulation provides that in the event of an
application relating to a very long document or to very large number of
documents, the institution concerned may confer with the applicant
informally, with a view to finding a fair solution.
With a view to finding a fair and practical solution, as provided for by
Article 6(3) of ATD Regulation, we would like to propose a disclosure
within maximum three months from your confirmation of this fair solution.
The proposed timelines take also into account that the third-party
consultations will have to be carried out during the summer, and that the
consulted third parties may not be available.
We hope that our proposal regarding the refinement of the timeframe of
disclosure meets your needs.
You are kindly requested to inform us whether you agree to this proposal
as soon as possible and no later than by 02. 07. 2024.
Thank you in advance for your understanding.
Best regards,

Dear ECHA ATD,
Thank you; I can accept but is it possible to agree a 10 week deadline? If so, please can you confirm the date that you will work to. Three months would make life harder for me due to some deadlines.
Thank you in advance.
Yours sincerely,
Vicky Cann
Dear Ms Cann,
Thank you for your confirmation and we confirm a 10-week deadline is possible.
We will send you the final reply with disclosure of the documents, by 6 September 2024 the latest.

Dear ECHA Restriction,
Thank you for the documents for 061/2024.
What is the approach of ECHA to requests for stakeholder meetings? I can see that some are accepted and some are rejected. How does ECHA decide which to accept and which to turn down?
Yours sincerely,
Vicky Cann
